So I know a patient from a previous pain doctor of mine that I used to hang out with. Well he got busted for growing marijuana in his house and this is all of his charges. He seems to think he will get off on probation and fines/community service (LOL) and I am thinking more like 3-5 years in jail. He only served 30 days so far in jail and is out on bail now.

this really comes down to what his prior charges are and if he was on probation at the time of arrest. Also, was the tobacco/cellphone charge while he was in jail? because that's retarded if he brought in a phone and got caught with it, makes him look like a kingpin trying to hide other grow ops.

How much weed was he caught with? How many plants? How was he caught? Was he caught while selling weed to somebody? Was there a lot of cash seized? Did he have weapons?

Maintaining a dwelling, paraphernalia and the simple possession don't mean shit, and if he's lucky that's what he'll plea down to. If this was his first time with felonies, I'd say he'll do some weekends and then intensive probation for several years, and loads of community service. He could probably get it down to house arrest in lieu of weekends.

However, if the state has a case to actually make those intent to sell charges stick (he got caught by somebody wearing a wire or during a deal with money exchanged) it will be a lot more likely he'll do time.

One of my old friends from high school (dropped out) is the most nefarious dude I still see from time to time and he's always bragging about the ridiculous shit he gets out of. Most recently, he got raided and they threw flashbangs in his house and everything because some kid got busted with pills and said that he had a bunch of them (he did, but not in his house) so when they raided they found a QP of bud, scales, baggies, lots of paraphernalia, $5,000 cash, etc. and charged him with all the same shit except growing. He got it all dropped except for simple possession and is just on probation.

I could go on and on about the shit this guy has gotten out of, including like 3 DWIs, grand theft auto, etc.

He uses Rusty Dement.

^^pretty much on point. whether he has priors dictates the outcome. best case scenario: misdemeanor plea and probation. realistic scenario: one felony conviction, all other charges dismissed, credit for thirty days, long suspended sentence, 18-24 months supervised probation.

He is telling you that he is going to get off with probation and fines/service because he flipped for the detectives that arrested him. He just left out that part.

More than likely they'll require him to help them get other people on a specific number of felonies and they will drop his, but leave him with the misdemeanors.

His rap sheet includes armed robbery for one of many prior felonies and here is more details on this bust in particular:

With prior violent felony convictions (as long as they were convictions and not dismissed), this guy is fucked.It depends on how much he got busted with, and if they caught him in the act of selling it. Possession and PWISD doesn't carry a mandatory. Sale and delivery (if they can prove it) and cultivation (manufacturing charge he got) both carry a 2 year mandatory minimum if it's 10lbs or more. 3 years if it's 50 or more.

He could roll on people if he already hasn't, hence the second quote, and get the bigger charges that carry mandatory minimums dropped and get less time, but he's already at the top of the weed food chain as the grower. I'd guess he'd have to roll on somebody pushing a lot of hard drugs, in which case he'll likely be killed anyway.
