I think we can all agree that while the prostheses did not give him an unfair advantage, his gun did.

I didn't remember the guy's name so when I read the link:south-africa-blade-runner-shooting/index.htmlI thought someone had shot a replicant.

Been reading about his defensive strategy. He doesn't have a leg to stand on.

Why are they even attempting to charge him with premeditated? It sounds like more of a case of what would be 2nd degree murder in the US.

all signs point to it being an accident

Negligent manslaughter

^^they do?The signs like:(1) Witnesses saw lights on(2) Heard hours of arguing beforehand(3) No intruder sneaks in, runs to the bathroom and hides in the water closet(4) He never checked the bed for his girlfriend when getting up? hell my wife goes to the bathroom in the middle of the night 2 or 3 times a week(5) good chance the bullet angle is going to show he had his prosthetic legs on, the time it took to strap those on is almost instant mens rea for the prosecution. Not sure what the murder statutes look like in South Africa, but this dude should likely spend the better part of the rest of his life in jail.

Mostly speculative, but from what I've heard:The people that heard arguments were a considerable distance away, like 1000 feet. Likely not a credible source. She was in the bathroom, and the door was locked from the inside. Even if it was an intruder the situation had already been diffused to the point where lethal force was no longer required. Still, the door being locked from the inside doesn't look good for Pistorious. If she was just up to use the bathroom why was the door locked?I read somewhere that the bullet entry holes in the door were 5 feet off the ground, a likely indicator that he was using his prosthetic legs. The gun was supposedly in a holster and stored under the mattress on the girlfriend's side of the bed.Again, all of this is through the filter of a sensationalist media.[Edited on February 21, 2013 at 12:14 PM.
