Seems like a case of sensationalism to me...Some people like to escalate a situation when there is no cause for doing so.I bet it was more along the lines of "hey ladies that's not appropriate - let's take it somewhere else"It looks like their response was the equivalent of "it's because I'm black, right?" No reason to put a securtiy guard on the defensive with an inflamitory accusation right away. Probably could have been handled better on both sides, but it never helps the situation to agitate an authority figure.The statement of the "supervisor" seems to confirm this when he says "You want this to be public, you want people to see what you are."Seems they were attempting to make a scene at this point. I don't know if you can say "making out" is obscene or not, but it's not really appropriate given the surroundings.what if we all just tried having a little social couth...

This is a PR issue, not a legal issue.It sounds like the actions of a rogue guard/supervisor. I'm amazed people would argue that the Civil Rights Act is not the law (who knows if the supreme court ever throws out decades of precedent, but it is clearly the law now), but it does not extend to sexual orientation in NC.

If sexual orientation was a protected class under the Civil rights act of 1964 (which it isnt), then it doesn't matter if your restaurant is on "private property". This argument was settled about 45 years ago in cases like Katzenbach v. McClung, 379 U.S. 294(1964). If the operation of your restaurant effects interstate commerce, (and the court has pretty much determined that EVERYTHING effects interstate commerce, so its just about impossible to wiggle out of if you are operating some kind of money making business), then congress has the right under article 1 sec 8 clause 3 of the constitution ("the commerce clause") to ban discrimination at the place of business on the basis of race, religion, or national origin.

There were a ton of people holding signs in the Wachovia parking lot around 2.I really have no idea what they're protesting. The establishment agrees with them that it was wrong and has taken action to correct it. If anything this seems like a team building exercise for the gay community and nothing more.
