To avoid a possible death sentence, Demario James Atwater, 23, pleaded guilty Monday to five charges, including carjacking resulting in death and kidnapping resulting in death in the March 5, 2008, shooting of Eve Marie Carson.
His trial was set to begin in U.S. District Court May 3.
Atwater, however, still faces the death penalty on state charges in Carson's death, which include first-degree murder, kidnapping and robbery.
Carson's parents said in a statement Monday that they support the plea deal federal prosecutors made with Atwater.
"While we deplore the evil and negligence that led to Eve's death, we agree with the U.S. attorney's decision to accept the plea agreement," Bob Carson and Teresa Bethke said. "We are very grateful for the dedication and hard work that have gone into the investigation and prosecution of this crime."
"I want to express my condolences to the Carsons," Atwater's mother, Peggy Maybrey said Monday, declining further comment.
Defense attorneys representing Atwater on the state charges, also declined to comment on the plea but called it "a sad case."
Calls and e-mails to the University of North Carolina at Chapel Hill were not immediately returned Monday.
Chapel Hill police say Atwater and another man, Laurence Alvin Lovette Jr., kidnapped Carson, forced her to withdraw money from ATMs, shot her five times, including once to the head, and left her on a residential street near the UNC campus.
Federal prosecutors allege that Atwater fired the fifth and final shot that killed Carson.
According to the plea agreement, which was filed Friday, Atwater also pleaded guilty to one count each of carrying and using firearms during and in relation to carjacking and kidnapping resulting in death, possession of a firearm by a convicted felon and possession of a short-barreled shotgun without such weapon being properly registered.
In addition to life imprisonment, Atwater could face a fine of up to $250,000. A formal sentencing is scheduled in U.S. District Court on Sept. 23.
"Eve Carson's murder was a senseless, random act of violence," U.S. Attorney Anna Mills Wagoner said in a statement. "We hope this resolution will help the Carson family put this horrendous act behind them, as best they can, and move on with their lives."
Atwater is scheduled to appear in Orange County Superior Court next week on the state charges. Orange County District Attorney Jim Woodall said Monday that the federal plea has no impact on the state's case, which still has not been scheduled for trial.
Lovette also faces several state charges, including first-degree murder.
He is not eligible for the death penalty, however, under a U.S. Supreme Court ruling that prohibits the executions of criminals under 18 at the time of a crime. Lovette was 17 when Carson was killed."

they shot her 5 times now he gets free rent(on our dime) for the rest of his life. anyone can get used to working out, playing basketball, lounging around all day.

shoot this dude 5 times. first 4 shots in very painful places that wont kill you quickly. let him lay there for a bit and then shoot him in the head.

I must agree with this...but give him a chance to suffer in prison for awhile...and after a few years, if it looks like he's not really suffering, then go through with your suggestion

So he gets to live because it is too expensive to fully pursue a capital murder trial? Fuck that.

Instead of life in prison with or without the possibility of parole, he should be given life in prison with the possibility of execution. Eve Carson didn't expect to be kidnapped, paraded around town, and shot in the street. This guy should be randomly, and without warning, picked out of his normal prison routine and shot.

when a law-abiding, intelligent person speaks of shooting somebody in painful places and letting them suffer on the ground for awhile...

what they probably mean is that the criminal deserves to have this happen, and that if our country were a dictatorship, they would be in favor of the dictator imposing this punishment on the criminal in question

not that they would actually be okay with the Constitution's being violated for the sake of making this particular criminal suffer

the whole problem with cruel punishments we'd "like" to inflict is, how to inflict them under due process of law...and, more importantly, how to prevent their being applied in instances where they would not be justified

the only way to do that, it seems, is to prevent cruel punishments altogether

but that doesn't mean they wouldn't in some cases be morally justified, in the absence of a Bill of Rights etc.

If I was facing life in prison without parole I would BEG the judge to execute me.

While inside I would murder any motherfucker who came at me as savagely as I could.

Unless of course they murdered me first.

Then you're either dead or in the hole until you are dead.

Either way, mission accomplished (kind of).

Also, this post as not been fully thought out.

@nerdchick In the time after that was written, people were routinely punished by beatings, having appendages cut off, being hanged by the thumbs, hanged by the neck, executed at firing squads.

No matter your moral or political feelings on the matter, execution does not violate the intent, spirit, or letter of the 8th amendment.

and that's permissible....

then it seems to me that we should be allowed to kill him, too.

for me, the difference is only one of degree. we've agreed to punish him, let's punish him.

he was talking about punishment we would like to inflict and how the dilemma is how to do so within the law

i was pointing out that not all people would like to kill a murderer, some of us think it is always morally wrong

well fuck, that article did hint they could still go for the death penalty on state charges but I dunno,

this makes me want to visit wherever the max security prison in NC is and make sure the guy's life will be complete shit, I really hope he doesn't get to just lounge out in the yard playing sports and listening to music all day, all the while eating better food than I was forced to eat in the public school cafeteria

You put a ton of faith in our justice system. While this guy did plead guilty for a lesser punishment, almost no one would plead guilty to the death penalty. And unless they plead guilty, there will always be some uncertainty in whether they are actually guilty or not.

for the great majority of every day, you just sit in your cell with absolutely nothing to do

that shit gets old really fast...and you have to put up with it for the rest of your life
