Anyway, just wondered if some of you had been through the appeals process and what you thought about it...I've got about 10 subpoenas to send out for documents/people and the burden is on the employer luckily since I was initally awarded the UI.

We had a girl that gave her notice and didnt even work her whole notice, just left in the middle of the day. She applied for unemployment and got it. My boss fought her and he won. SHe had to pay it all back. LOL

Me, my girlfriend, and a third employee all won our appeals. I highly suggest you get a lawyer rather than going it alone. If we hadn't gotten a lawyer, we would have gotten destroyed. I've been through an appeals process and the unemployment office can and will bury you in paperwork you don't understand quickly. Get legal services for this, especially if you may be drawing for an extended period of time.(Note: They need folks to work a number of holiday oddjobs ... start applying / looking for temp work now as they are hiring now).

We used Legal Aid and it was totally free. Our lawyer was awesome, too.

In my experience the employer rarely, if ever, wins an appeal. I mostly get "Unfavorable decision regarding John Doe" emails, even if its a case where someone just ups and quits.

^^lawyer. and in person aren't always better, just fyi!it doesn't make a difference over the phone/in person. it really just matters who is hearing your appeal. is your employer using an attorney for the hearing (or do you know)?

i was used as a witness for a case where i worked. the guy wasn't fired, he just stopped coming to work and then filed for unemployment. boss appealed with two witnesses and the guy still got unemployment.

no they arent using a lawyeri dont think i will either and its because the old hearing official (who would have done the telephone interview) has basically taken all of my calls and given me the best advice i could think to have. she let me know what type of witnesses would be good and which would hurt me even if i didnt realize it and stuff like that.
