So I recently was involved in a accident where some moron turned left in the middle of in intersection on a one way road into my right front fender/tire. He was at fault and his insurance is paying for my car which ended up being totaled out. They are giving me almost all of what was still owed on my car and my gap coverage is covering the rest. I have had to take time a lot of time off work to try and find a car, and have spent hours on the phone trying to get my claim settled. Another attorney in the building I work in said you can "go a few rounds" with the insurance company and get inconvience money, lost wages, and money for work/taxes recently done/paid on the vehicle. Has anyone ever done this?

Isn't it inconvenient how your neck hurts when you tilt it back all the way and try to turn it.

most of the reason I want to get inconvenience money is because i've taken a lot of time off to find a car and then couldnt get one cause they hadnt paid my claim yet. they took FOREVER to get it done. they didnt pay my claim until the day the rental car was due back. and ive had to use vacation days to shop for a car and now no vacation

I take it you're not driving a super rare collector's car, in which case you should be able to find a new one over the course of a weekend

"Oh hey boss I won't be in today, I'm shopping for a new Kia" won't fly at most places

^^I took partial days, wanted to make sure i got a good car i really liked cause my last cars sucked. Test drove a bunch of cars and went to lots of places to compare. also kept having to go to places that were trying to get me approved for a loan to sign shit that couldnt be faxed, only to find out i couldnt get approved cause geico had not settled my claim. long story short geico sucks

yeah, it kind of sucks that you needed multiple weekdays to do something that most everyone should be able to do over the course of a weekend or two

it also kind of sucks that you had to take time off to handle your claim when almost all insurance companies are open more than just 8-5 (geico is 24/7/365, IIRC)

sounds like you're just a rare case...sucks that life sometimes doesn't care if events are inconvenient

In your case, it sounds like you were upside down on the car, and you're probably going to end up driving something nicer for less money considering the economic conditions that we in.

They may have done you a favor.

My BMW was hit a few weeks ago. 100% the other persons fault. They admitted it from the get go. It ended up being a big favor, because the one bad spot on my car was the rear bumper, and I got that replaced and repainted to new (I was going to have to shell out 500+ to do this).

If you 'really' had to lose a lot of time over this (you lost vacation time at work), then you have a claim for some extra money, but unless its a lot, you should just suck it up. I was satisfied that I got a rental during all of this (I assume you did, as well) and got the work done quickly.

One of these days you are going to hit someone and be at fault. Hope its not a doctor that values his time at 200 and hour and sticks you with a much larger bill if he follows your lead.

^^ eh i was slightly upsidedown i guess, i owed 8003 on my car and they valued my car at 6520. so gap covered the remaining 1400 or so.

i wasnt able to car shop on weekends, because of work schedules for both my mom and i and a lot of the dealers i tried couldnt do anything on sundays for some reason?

its all new to me, im still without a new car cause the economy sucks and ive now had to pay out of pocket to extend the rental cause they didnt pay the claim off until the day the rental was due. they apologized and said it was their fault but didnt offer to extend the rental

You really think they should pay you for this? And car dealerships are open outside of normal business hours. You could have easily found a new car in the evenings and on weekends. I would expect the insurance company would laugh at you. But hey, good luck.

you mean you didn't demand that they extend the rental? silliness.

get a list of everything you had to spend to get back to where you were before the accident and see what is inconsequential and what is actually valid and claim it. even the gas you put in the car before it was totalled. put rental car fees on there.

most car dealerships i've seen are open til at least 9pm. you might have a hard time arguing that one.

They always act like they aren't supposed to pay for stuff they are required to, in hopes you're dumb and will roll over and let them piss on you. Like I said, I had to spend a month going back and forth with nationwide to get a half decent amount for my motorcycle. Thankfully I'd bought it in the dead of winter for a great price so I got $100 more than I paid for it (20k miles previous) when you consider the loss of use amount.

^ maybe you covered this, but please tell me why the dealership would need to contact the bank? they can run a credit check on you without the bank being open...as for you getting a loan from the bank in order to purchase a car (the only reason i can think of that the dealership would need to contact them), why would that stop you from doing your car shopping in the evenings? so you pick out the car you want and then you go back the next day, taking a single half-day instead of a half-dozen half-days for no good reason

i'd definitely argue the rest of the rental car reimbursement, though

If I recall from when I had to deal with this last summer, if the claims already been settled I don't believe you can get inconvenience money. However, had you negotiated this before the claim was settled then you probably could of got an extra $500-$750 out of the insurance company. But I'm not in the insurance business at all, this is just personal experience.

^^ since my mom was co-signing she wanted to be there once i had narrowed it down and she works from 6-8 or later at night they had to contact the banks to tell them what had happened and we werent trying to have a third loan

of course they are. insurance companies are gonna give you the run-around every chance they get. they have all the time in the world to be persistent at not paying you what you're due and they know that you don't have time to be persistent at getting what you're due.

it sucks bad. my sister got this same kind of run-around bullshit when she was trying to get what she was due after her accident. hell, the other insurance company had already sold her totalled car off to a salvage yard before they officially took responsibility for the costs due to the accident.

persistence pays off when you're dealing with these asshats.

You should get in touch with YOUR insurance company -- when you are not at fault in an accident, they will go above and beyond to make sure you know exactly what you are entitled to, and what processes you need to go through

I think the point he is trying to make is that dealerships are open on Saturdays and open pretty late on the weekdays.

in other words, no judge is going to reward you money for lost wages when you were taking time off to do something you could have easily done outside of business hours

I don't know the full story behind this or all the facts, but I in general, no, don't go this route. Otherwise, I would be filthy rich as inconvenienced as I have been waiting in traffic for the past XX years, as inconvenienced as I have been waiting for other people at work to finish their part of the project, as inconvenienced as I have been for ...

Move on with your life unless the amount of time you are willing to put into this is and the return you think you may potentially get will exceed what your time is worth. And once again, not knowing the full facts, think on whether this is ethical or not.

I'm an independent agent appointed with about 15 different insurance companies and I've never heard of someone getting "inconvenience" money in a claim. You need to get an attorney before you could even think of pulling something like that. And, lost wages would only arise out of a bodily injury claim. Why should the insurance company have to pay for you to take time off work to shop for a car?

yes but a criminal and traffic attorney, we dont do insurance or personal injury.

- this isnt something a judge looks at or i take to court
- ive already been informed lots of people do this, ( by a couple of attorneys who do this for their clients, and one who has done it for themselves)
- it doesnt matter when i did the shopping for cars really just that i had to do it period.

i was just looking for people who have done it and where exactly to call and how much to ask for the few of you idiots who claim i cant, i really hope you dont get in a wreck cause you will probably go broke, and the others that helped thanks. the most i can get is $1000 and thats stretching it.
