Okay,Here is the story,I leave dealership (looking for car). and start out in right lane. I then shift lanes into the left lane going about 30 ish, and accelerate normally. I had seen a truck but it was a ways back. I all the sudden hear brakes behind me. I hit the gas all i could but i got rear ended.Here are the pictures. I ended up getting supermaned through the windshield and probalby went 20 feet, besides a nasty bump on my shin i seem okay.Thank god for gear.

i sure hope so. there are very very rare cases of the rear ender so to speak NOT being at fault but this looks like a pretty clear cut case to me..

My friends heard the cop say that I was driving recklessly and thats why he wasnt giving the other guy a ticket. Poor RR and Ryan. That's pretty crazy no matter how you look at it. I guess there goes those "Built ford tough" commercials since the Honda did more damage to it then the ford did to bike. i've wrecked 4 times1. tucked the front end by trying to brake hard in a tight corner on my '82 SECA II right after I started riding...only going maybe 10-15 mph when I ate it. I think it broke a brake lever and a mirror or something. gave me a couple of scrapes. no big deal. 2. spun the rear wheel while cranked over and lowsided at about 30-35 on my YZF-600. broke the windshield and levers/mirrors. i was in leather jacket/gloves/jeans. jeans shredded to ribbons almost instantly; rashed up my leg enough to kinda suck, but not enough to warrant a trip to the hospital.3. was riding my GSX-R 750 with C16H13N2OCL...we got bored on straight 4-lane road heading out to the twisties, so we were taking turns riding wheelies. he'd ride one, sit it down, then i'd ride one until i caught up to him...well, I rode one up to about 110 mph and held it for a little while, and he was going slower than I thought...since I was directly behind him (instead of in the other lane, it was tough to judge closure, and I sat it down just a little too late. i got on the brakes HARD, and needed about 1-2 feet more than I had...my front tire touched his back tire while I was still on the brakes hard, and BOOM! HUUUUGE tankslapper. I was probably going 80 mph or so when I got thrown off. Fortunately I was in full roadrace gear: 1-piece leathers, teknic boots and gloves, full-face helmet, and probably spine armor. I slid down the road like superman for a little ways, then got turned sideways and started tumbling (i just remember seeing groundskygroundskygroundskygroundskygroundskygroundskygroundsky). the bike just slid, and the only damage was scraped/cracked fairings. I picked it up, got it restarted, and rode the shit out of it for about 2 more hours.I'm glad I didn't take Chad out...that was a real fuckup on my part.4. about 2-3 weeks later, lowsided the same GSX-R at Deal's Gap at about 50-55 mph. Tore it up pretty badly. I slid on my back, headfirst into a ditch...came out fine, though (again, full roadrace gear).I still don't know what caused that wreck. I'd eased up my pace considerably (figuring that I'd run out of luck for the day after a few close calls). I was riding a quick pace, but not like I had been earlier in the day. I wasn't going THAT fast or gassing it that hard...didn't see any gravel/sand/leaves in the corner afterwards...maybe the rear shock got heated (sounds like a long shot)? My best guess is that I got on the center painted line without realizing it and gassed it a little harder than I realized.Finally learned my lesson after that (I think) and started riding with a little bit of restraint.C16H13N2OCL, motomike/motomikeh, and r1pimpin and I used to ride together a lot. I think we'd had about 2 dozen motorcycle wrecked between the four of us by the time we all graduated NCSU and left the area (some of those were on track, though). I was wearing my hjc helmet (lots of scratches)Teknic speedstar gloves (little damage on the palm sliders)Teknic mesh jacket (scrapes and oen rip)Jeans (nothing i can even see on them)Some Ariat boots (sraped up to all hell in places)But yea besides a golf ball sized lump and alot of soreness (feel like i got beaten up) im okayDamage on the bike..Ill need a new rear rim, and the rear subframe looks bent up, but i really dont know. the insurance companies have hundreds of lawyers on payroll who will be fighting for their clients. experience says that since HE hit YOU that the insurance companies will find him at fault. meaning you get paid. the only thing you have to worry about is if you actually pulled out when you shouldnt have, AND his insurance company can somehow prove that.

Did he lock the brakes up? Cant they measure his tracks to determine if the truck was speeding?If so, that should be all on him as he pulled out thinking that he had enough time before the truck got to him had the truck been going the speed limit.

My experience has been that with insurance in North Carolina, if it's not 100% his fault, you're paying for your own shit. And since the cop didn't write him a ticket, you're probably not gonna have much luck saying it was 100% his fault. Chances are, you're paying for your own shit. Or your insurance is.

i just dont see how he sees the truck, decides he has enough time to pull out, putts up to 30mph, hears tires squealing, gets rearended by a fucking explorer and only goes over the handlebars? if he was going slow and the truck fast, he would havent been able to hold on and went onto the hood/into the grille backwards.if he was going 30 though, and the truck going 45, or 55, or whatever locks up it brakes long enough to be somewhere near 30mph or less then he would have been able to hold on until the bigger mass stops (explorer speed hits zero) then be thrown over the handlebars (like he claims)Im no fucking scientist but it should be fairly easy to tell from the skidmark measurements on the accident report, and weight estimates of the vehicles. is it online yet?

not online yet. The truck had abs, so no skid marks that i can see. plz, never trust mirrors on bikes, besides, they are mostly worthless. That's why I don't ride with any. Easy to just turn your head and look. Unless you are about to go into a turn, look back then find yourself going off road at 100mph+ into a grassy field missing the mail box and telephone pole by a foot...
