Part of the process of collecting on it includes sending a letter, so yes, there will be a letter.But I recall the woman who gave us the check, and I don't have much faith that the letter is going to compel her to pay. She was rather short on courtesy, manners, and tact.

Yeah in Wake County the DA sends a letter and if you do not respond in 45 days or so you get charged (warrant issued, goes on record). I had a check from Food Dog that this happened to. The problem was I fucking called Food Dog trying to find out how to pay the check and they kept saying I did not have any bad checks with them. Then after I found out I was being charged of course I called an fucking freaked at the customer service people, apparently my DL number was keyed in their system wrong and that is why they kept erroneously telling me I did not owe them money.I had to avoid the cop that was looking for me, go to the courthouse and get a judge to recall the warrant, and then pay the check $27 check plus about $80 in fees. Then I asked the judge if it was a conviction, conveniently enough paying the check = pleading guilty to misdemeanor worthless check. Obviously I am pissed at this point because of how Food Dog dicked me around and then I had to pay all that, sit through a ghetto ass courthouse wedding (the bad check judge also performs marriages for $50) and then they did not even dismiss the charge. I was like well I am probably gonna have to get an attorney (not in a rude way just matter of factly). Then the Judge reaches over and fills out some form and was like ok now the charges are entered as dismissed. It is still on my record but it just says "dismissed without leave" next to it. Then this got me thinking about the dozens of people that go through every day, that do not know any better, don't bother to press them for that and end up with a conviction on their record.]

My mom has been an interior designer for many years (running her own business) and before she began taking credit cards at home shows, she accepted checks for retail products in her booth space. Long story short, she had a women write 2 bad checks over the course of the weekend which amounted to ~ $500 total and the women obviously took the product home with her.We live in an age where you can sue the owner of an establishment for tripping over your shoelace in their parking lot. You could pursue this person legally-- or you could do the right thing and contact them and let them know that the check bounced and give them a chance to correct the problem. There are people and families out there battling cancer, chronic disease and other serious personal issues... sometimes a checkbook doesn't get balanced and things get overlooked. As it turned out, in the case with my mom's customer the woman's mother had just passed away and she was behind in managing her finances. As soon as she realized what happened she immediately made good on the check. That being said, there are also people out there who just write bad checks. But you shouldn't make that assumption right off the bat. I know if I accidentally overlooked a small check, I would want to be given the opportunity to correct the situation before someone dropped serious legal hassles on my doorstep.[Edited on March 10, 2008 at 11:22 AM. Thanks, Str8BacardiLI'll make sure that she knows this is a possibility - I'll include it in the letter^And that's why I'll make sure to spell out what I'm doing, why I'm doing it, and what she needs to do in order to avoid things from escalating. Sending the first letter doesn't automatically mean it's getting sent to the courthouse ]
