So it has come to the fact, I am going to be involved with suing a business. We sold a store collectible cards for 3300. The due date for the balance was in Oct. They have refused to pay the balance ~2000. Can any of you recommend a good attorney? I know it will be an easy win. We have a contract, witnesses, etc.

small claims court is easy - it's one page to fill out and only costs a few bucks (from the front door of the courthouse you can have it all done and get your court date in 30 minutes). you then go stand in front of a judge and half a dozen people who didn't pay their rent and say "here's the contract, they didn't pay me"[Edited on January 23, 2008 at 11:31 PM. i think it costs $12 to file a claim in small claims court. pretty easy.

When I filed it was $50, and the cost went to the loser of the case, so I got the money back.

We sold the actual collection last Sat. for over 5k. This was a rest of another collection we sold to a local store in Cary, NC. They deal with magic, baseball, etc.Side note.....we will be married Aug.HI Ben!!

I'd like to point out that even if they rule in your favor, there is no way to force them to pay you. All you really get is an official IOU. There's no wage garnishing, etc. in NC.

WE talked to someone and they explained the steps.We gave them the demand letter and they apparently are not inc. which complicates things. We heard from an inside source that one owner is making the other owner take out a personal loan to cover it and we should get paid next week. Just hearsay......^^^^^^And about marrying Eddie..I have no hesitation. I have known him 6 years and he has changed a lot in these last few years. We have lived together for 2 and have bought a house together. He really has matured a lot.

small claims court takes forever, better hope they do the check thing, or you will not be seeing any money anytime soon(and you will also have expenses taking them to court, which is long, drawn out process) You would be better off appearing on Judge Judy.
