If my neighbor backed her car out of her driveway, and hit my car parking on my front yard, that would be her fault, right? She tried to say that where I parked is "public" land, but I don't think it really matters, because she hit a PARKED car.
12/24/2007 1:41:09 PM
its doesnt matter, she hit your car, she is responsible
12/24/2007 1:42:12 PM
it shouldn't matter where you parked she still hit your car
12/24/2007 1:43:51 PM
One or both of you is obviously retardedI'm thinking both
12/24/2007 1:45:18 PM
hahahhaha
12/24/2007 1:52:38 PM
still probably her fault unless you were on her land, in which case it may get more complicated I would suggest calling student legal asap if she doesnt really work with you. Good luck with that man.
12/24/2007 2:04:18 PM
Unless you have a way to prove she hit you, which I would work on getting ASAP if you can, you might be out of luck. My neighbor once backed into me and left a note, but then she started being a bitch and avoiding the insurance company, etc. They said that if she hadn't left the note I would have been screwed.
12/24/2007 2:13:53 PM
she hadn't hit me yet, but she threatened to call the police if i keep parking my car there. I think it's a bit rediculous of her to call the police, since I believe she has no legal ground for this. Btw, she lives across the street from me, so there's no way my car is on "her" land. I'm just asking to make sure that if she ever hit me in the future, it's not my fault.
12/24/2007 2:39:55 PM
Regardless of whether you're on your land or public land, she can't just hit your car and not be legally responsible. But if she wants to, I'm sure she could easily find a way to do it and cover her tracks to fuck you over.
12/24/2007 2:51:13 PM
^^ tell that slore to STFU. what are the police going to do b.c your car is parking in front of your yard. last time i checked it wasn't against the law to park your car on the side of the road in residential areas.
12/24/2007 2:57:44 PM
look, get proof about this time she hit you and you park your car wherever the hell you wantif she does anything to your car, you know where she livesyou know what im saying?

As long as there is no law prohibiting you from parking in the public right of way on/off the street or law that limits the amount of time that you can be parked there, your neighbor has no legal grounds for complaint -- even if you were parked in front of her house. And if she ever were to back into you, it would be her fault for hitting a parked car.I would give a call to local law enforcement just to ask them about residential parking regulations to double check that there are no laws in place that prohibit you from parking there.
12/24/2007 7:14:11 PM
I't funny when people think they know the law, and really don't know shit.
12/24/2007 9:53:07 PM
instance where my car was hit while parked... i was told that since it was parked, and had been for a while, that it was the other person's fault (which in my case it clearly was her fault for pulling in past it to park and then leaving later only to back straight into it)
12/24/2007 10:55:08 PM
threaten to kill him on the internet then have the...cops? show up at your door?
12/24/2007 11:00:11 PM
stalk that bitch on myspace

A public street is "public" land, so I'm not sure what she is getting at. I guess you can take a sledge to someone's vehicle as long as it is illegally parked. There may be ordinances or HOA covenants in place to prevent you from parking in the grass, or obstructing a sidewalk, but that has nothing to with liability from hitting a parked car. If you were illegally parked, she may be able to get you ticketed and/or towed.By parked in the yard, do you mean two wheels were in the grass or your whole vehicle? Is it a public or private street? Are you in or out of the right of way?
12/26/2007 11:36:47 AM
Did you tell her it would not matter who owned the land if she looked behind her when she backed up? I mean what if an old lady was walking behind her and she ran over her, I guess that would be the ladies fault too.
12/26/2007 12:04:13 PM
Maybe you should tell her she can't pull her car out of the driveway and onto the street since it is "public" land.
12/26/2007 1:35:11 PM
12/26/2007 1:42:33 PM
Why don't you just park a few feet back/forward so she doesn't hit your car?
12/26/2007 2:07:06 PM
why dont you just park in your driveway?
12/26/2007 2:41:33 PM
Why don't you just kick her in the face?
12/26/2007 3:02:47 PM
12/26/2007 3:07:27 PM
I think we aren't getting the entire story. It seems like where you park is making it difficult for her to easily enter the road from her driveway. Perhaps you could do as someone else mentioned and park your car a few feet away to diffuse the conflict.
12/26/2007 7:41:58 PM
I mean even if he is being a complete douche about where he parks its not his fault if she hit his STATIONARY car. If she had a problem with the location of him parking a good time to voice that would have been before she ran in to his car.
12/26/2007 8:10:35 PM
Str8BacardiL Guess you didn't see this:
12/26/2007 8:32:49 PM
Its still completely legal to be a douche.

^Indeed it is.

handle your shit, dude!call her bluff...you should be callin the cops if your car was on your land and she hit you.
12/27/2007 12:21:53 AM
I am gonna put a few cameras on my land rover and start parking it like a douche.INSURANCE CHECKS FTW!

wtf...she can't back her car out of her driveway and avoid hitting your car parked in your YARD?! she needs to be culled
12/27/2007 5:05:29 PM
just an update, I talked with her again today, and she said that the car was on "DOT land", not on my yard. Also, she said that she talked to the sheriff, and the sheriff told her that if she hit my car, I'm on my own. I was like "whatever, if you hit my car, I'm taking you to court."
12/29/2007 6:39:36 PM
daaaaaaaaaamn...fuckin drama.let that shit go, dude...go about your life with less stress.
12/29/2007 6:56:36 PM
One thing that you should learn as an adult is to never ever take someone's word. If you want to know the legality of the situation, you should find out for yourself. And this is straight from the NCDOT Driver Handbook:
12/29/2007 7:50:10 PM
also, regardless of it being her fault or not, you should check with your HOA (if applicable) for any rules about where you can park, how many cars you can park in the street, etc. even if you don't know about them, they aren't posted, or whatever, you agree to them by living there.
12/29/2007 9:58:07 PM
ha, if the dude's parking on his lawn, there's no HOA. This ain't that kind of neighborhood.
12/29/2007 10:04:36 PM
An HOA can't restrict parking on a public street anyway. Why don't you just move your car off the grass and park on the street?
12/29/2007 10:19:47 PM
But if its a private street they can just tow your ass.
12/30/2007 12:14:29 AM
Why don't you just follow her in your car after she leaves her house one day. Wait until she parks at the mall or whatever and ram right into her car... it's not your fault, her car was on public land.BTW. All this sounds made up.[Edited on December 30, 2007 at 12:30 AM. Reason : -]
12/30/2007 12:29:04 AM
you should deflate her tires at night.
12/30/2007 12:33:29 AM
i'm not in a HOA neighborhood, the car is definitely is in plain view, can be seen far away. The only reason you will hit the car is that you don't look back before you back out.
