Go ahead and flame away but:I was in a wreck a few weeks back that my insurance company said I was at fault for (pulled out in front of someone duh). The problem that I am having is that the other guy that was involved had a suspended license and received a ticket (I did not receive a ticket), and he went and got a rental car that night on a suspended license. Now my insurance says they have to pay the rental car company for it even though he knowingly and willingly committed fraud by renting a car in his name with a suspended license. I'm also having problems with the collision portion of my insurance company. They called today to say that the body shop said that the car was not road worthy at the time of the accident and that it had frame damage before. This was a car I bought as a wreck and had it fixed at reputable shops and jumped through the hoops to get it inspected. It does have a salvage title but passed all of the DMV preliminary and post repair inspections no problem. The car was considered road worthy by the the state of NC but they are giving me a hard time saying that it had """""frame damage""""" . Have any of you guys had experience with any of this?

i would think your company would have an easy case of negligence against him since he wasn't supposed to even be on the road, but i don't know.that said, i'm not aware that it's illegal to rent a car with a suspended license. just like you can still register and insure a vehicle if you have a suspended license. you just can't drive it.
