Happened today on trinity. I was going like 30 after braking and then flipped off bike after slamming crotch into the gas tank. went into the cars windshield then rolled to the ground.

uhm chief i am a guy and i have lacerations and traums to my schlong. which looks like a crown royal bag in color only slightly burnt and bleeding a bit. was her fault so her insurance should cover it all. i assure you that you can't sue the individual person, only the company. that's one of the main purposes of having insurance, to protect yourself from being sued. even though you can sue the company, you're still limited by the limits on the persons policy. if they only have 100k of coverage, but your exspenses are 200k, guess what? you're screwed. that's why it's important to carry as much uninsured/underinsured coverage as you can on your own policy.[Edited on September 5, 2007 at 7:53 PM. The kid ran into and totaled a car whose worth exceeded the amount of his state minimum liability coverage and ended up being responsible for the difference. dude, i don't care whose grandma's brother you know that this has happened to. everyone has a story. mine is that i have been through this EXACT same stuff over the past 11 months. as in, i talk to my personal injury lawyer once i week. i've been through all the insurance talks/interviews. i've filed suits. my exspenses far exceed the coverage that the guy who hit me had. i'm hardly a legal expert, but i've been through the rounds of this subject personally and currently. not just heard what a friend went through.again, i promise you that you personally can not sue an individual person for excess losses. in the situation you mentioned, find out who actually sued your friend. i guarantee it was the other person's insurance company to get back the money they had to pay out to their client for the difference in the value of the car. remember some of this varies by state laws.My mother had a bad accident, burned though the other person 100k coverage in a minute, layers investiaged the other persons assets, and found he had an decnt house with equity, but the guy had 2 kids and a wife, mom wouldnt go for more than insurance max, but it was definatly an option to go for the house and other assets.This is why they sell umbrella insurance, to protect your assets incase something random happens that maxes out one of your other insurance policys.[Edited on September 12, 2007 at 1:03 PM. I'm not a legal expert myself but given that case and from my discussions with my own insurance agency, if I cause property damage in excess of my coverage, then I will be personally liable to makeup the difference.Bodily injury maybe very well be handled differently then property and obviously you have an ongoing case to the contrary of my understanding.Anyway, lets just agree that it fucking sucks balls getting beasted in an accident.
