Most people's leases are Aug 1 - July 31.

If you were to sign a new lease at a different location that was Aug 1 - July 31 of the following year:

1) What time do you generally have to be out on the 31st?
2) What are you supposed to do with all of your belongings (bed, desk, etc.) between July 31 & Aug 1?

I am just wondering how lenient apartments or townhomes are during the process with the time lapse over night. Any personal experiences are welcome or if you have factual information. The lease that I saw didn't really say anything about a specific time, so I didn't know if midnight was right or when the leasing office closes was more appropriate.

i believe you have to return the key before the office closes at most locations...some apartments have drop boxes out front where you can also leave the key...I would suggest asking the management this is probably going to be a case by case situation.

i thought most apartment complexes and stuff will allow you to start a lease any day, not just the 1st (eg Aug 12, '07 - Aug 11, '08), subject to availability of a place. last time i moved, i got like a week of overlap to move/clean.

i would ask the rental office people to be sure

but seems like if you pay for a lease for X number of months, you get each entire month meaning you get the entire 31st of the last...so there wouldn't be a lapse.

i'm just trying to be fair. i own my townhouse (centennial campus). my room mates signed formal leases, but they are just the standard NC lease form that is 6 pages. It is specified that it is Aug 1 06 - July 31 07. Both guys are moving out, one of them early = no problem, the other one at the deadline. my buddy who is coming into the room that is occupied til the deadline has to be out of UHouse by July 31 (assuming when the office closes) which makes an overlap if my current room mate can't move in a night early.

^ with you being the land lord, just be fair to the guy moving out at the deadline, and your buddy moving in on August 1, maybe let him keep some stuff in the living room or something that night where there is a lapse.

why does he have to be out a day early. if he paid a full months rent for july then why does he have to be out on the 31st?

I don't know. That's when the lease is up. I am assuming that they have to be out by the time that the office closes on the 31st b/c otherwise they can't process everything until the 1st, which would technically be late. I don't think it makes sense, but it is a formality.

This has been more like what my experience has been... Ex. Lease starts on May 19, 2004 and ends on May 19, 2005, with new lease starting on May 19, 2005, whether it's in the same apartment or a different one in another community.

the problem comes down to whether i would rather play the role of the landlord or the friend...hopefully i'll find a reasonable solution and learn from this lack of planning.

at UHouse, last year, they made us be out by 12:00 or 2:00 PM that day, I can't remember which, but we definately didn't get the whole day.

could he rent a uhaul to keep move/keep is belongings in that night and just sleep on your couch?

If it's in the lease it's the law. If it's not in the lease but "their policy" it doesn't count.

Out BY July31st with no time constraint means out by July 30 11:59pm.

If it says July 31st at 5pm keys turned in, house ready for inspection that's different.

Don't forget to tell them 2 months ahead of time that you are moving out before you actually move out (depending on the contract). Last time I tried to leave my place it was a huge hassle because I didn't know about that 2 month prior notice.

done that before when I was in that situation--it's a viable option. Also, you could let the dude keep stuff in your living room for a night, it shouldn't be a big hassle for just a day or two?

Easiest though is just to allow yourself some overlap. Last time I moved, the rental term on the house I was in was up on July 31. So, I moved into my apartment in mid-July. Rather than doing a year ending on an odd number, I chose to do July 14 (or whatever day it was) to July 31 of the next year; rental company had no problem with letting me do the partial month at a prorated amount.

yeah, thats what im planning on doing too - although it might cost a little more, its less trouble and you actually have somewhere to put your stuff.
