oh boy, we should have fun with this. Just report every person that you don't like or have beef with and say you over heard them saying something about VT shooting when enough 'investigations' have been started they might get the picture and realize that they just pissed on the constitution.

Had the exact same incident in high school about paintball guns. Got suspended for fifteen days, and had to write letters of apology to two teachers, then stuck in ISS for another two weeks. That shit is pretty fucked up, especially that dude facing military discharge.

now if the guy actually communicated threats to the employee...thats illegal

but if the employee overheard something he didn't like, or a threat he thought he heard, it doesn't count

im wondering what happened

but im also concerned at the campus throwing in all the extra citations, searches, and beef they took from investigators

they arent charged with anything related to what was said.

they're being charged related to alcohol and "stolen traffic cone(s)" found in their dorm rooms subsequent to the police search

I'll go ahead and put it out there. I don't know if there was a search warrent, but I wonder if those kids knew how to handle it.

Like if there wasn't a search warrent, did they allow them to search, give consent, if so that's where they messed up.


Even if there was a warrent they still don't have to give consent to the search. That way if the police searched something they weren't allowed to or there was an error in the warrent anything found during the search cannot be used.

It doesn't matter who you are being searched by or where you are. You never give consent to a search. Even if they are searching you should make it perfectly clear that you do not consent so that there is no dispute. You say "I do not consent to this search."

That way if there is ever any sorta of loop hole that can get anything they found in the search out of the case they can because you didn't consent to the search.



My roommate got herself in trouble for that last year.

Campus police came in response to a domestic disturbance and saw that both her and her boyfriend were drunk. They asked if they could search the room and she said yes, they found her beer and she got in trouble.

I wasn't there, therefore I wasn't able to give consent and they couldn't search anything of mine, I even had illegal things in there, but they couldn't do anything because they didn't have consent from me.

lol, I think you misunderstand the law.

And it doesn't matter if you consent, it's the dorms, they are allowed to do just about whatever they want.

The girls car though... I'm guessing she consented to.

well cousins isn't the law....I'm saying the guy who has a court date, if they did anything illegal in finding things in his room there are ways he could get out of it if he didn't consent to anything

If the "police" had probable cause to search the rooms, they do not need consent. Its hard to consider what someone else said they heard "probable cause", but after the VT incident, a judge wouldn't throw it out.

Yep, they can. You live on public property. They can look through your shit all they want.

This is pretty easy. Dont do illegal shit in the dorms and you can talk all the shit you want at Fountain dining hall.

dude if that is all true that is some fucked up shit.

i should just go to campus police and make up a story about someone i don't like saying they were going to shoot a bunch of people. I just can not beleive they actually gave citations to the guys w/ the cones.

Maybe the gov't should pass a bill requiring MANDATORY searches of all residences. This way we can all feel safe since the police will find all the drugs, guns, and other bad stuff. After all if you do not have anything illegal you would have nothing to worry about

so:

Some guys were talking about shooting ppl in dorm rooms, not anyone specific. The police question them, and they answer questions.

So student conduct raids their dorm rooms and finds alcohol and other items to send them to the judicial board on unrelated charges.

Classic Paul Cousins action.

speaking of baseless accusations leading to ncsu police investigations:

when I was a freshman, I was brought in to be questioned about being physically abusive with my girlfriend. at the time, I didn't have a gf and hadn't for about a year.

when I was a senior, a handful of campus cops, the RD and a DEA agent showed up at my wolf village apartment to confront me about a "series of complaints that I was selling drugs out of the apartment." Anyone who knows me knows that I don't touch drugs at all. hell, I only drink once or twice a month.

since completely innocent people are harassed over entirely fabricated complaints, I'm not surprised that something just vaguely connected to reality is being used to railroad these people.

entirely not true. They are only allowed to search for things that would be in plain sight in University owned property, also, as per the leasing agreement with the University, the police need probable cause to enter your room in the first place. Meaning, they can look in your room and closet, but if there is anything covering the items, such as clothing, or it is in a backpack they cannot do anything about it. They are prohibited from rifling through your possession, unless they have a search warrant.

Likewise, it sounds like they would not have had probable cause for a search warrant, and therefore would not have had probable cause to search the room or the car.
