I got in an accident, but I didn't get a ticket cause it wasn't my fault. They cited the road as the issue. I did hit another car, but I was determined to not be at fault by the police. why do I have to pay for the other guy's car to get fixed? Thanks!

Because your insurance company determined you were at fault or the evidence looked like the other insurance company would win in court so they agreed to pay and admit you were at fault.When the police don't ticket someone it's left for the insurance companies to sort out who is at fault or not. You can fight it, what are the details, what did the actual police report you picked up say/describe the wreck? Have you asked them why you're at fault?By your description alone it seems you were at fault and were hoping the road contributed would get you out of it. Your insurance pays because the other guy had zero responsibity fo r the accident. Your car lost control, no matter what the road conditions and hit him. It sucks, but he isnt responsible. While you may not have comitted a ticketable infraction, the accident and damage was caused by your car.

as long as the damages are below $1800 you wont be surcharged at all. If it is more you will probably be given one insurance point.

Well, yes, obviously logically I was at fault, but legally I wasn't. I hit the other car, fair and square, and the guy that caused the wreck got away. I was turning left at an intersection and this car was turning left from the opposite direction. He ignored the fact that I was in the interection, turning, and I had to floor my car to keep him from hitting me. The car that I hit was stopped on the road I was turning into trying to turn onto the road I was leaving. A bit hard to explain in writing...

don't cause another accident in order to avoid an accident, unless you feel your life is in danger. otherwise you end up screwing yourself over.

Well sure, but I'm the one it's going to cost. The guy was headed straight at me, he would have hit me head on and probably knocked me into incoming traffic. i didn't want to take the risk.

If you avoid a wreck that would have been the other drivers fault by causing a wreck that is your fault then you're fucked.If the events occured at really high speeds then you made the right call, if they weren't then you suffered through lifes "at the wrong place at the wrong time"[Edited on April 25, 2007 at 12:59 AM.
