Irony #1: I work in a law office.I got a possession of a malt beverage under 21 years of age ticket 6 months ago and was granted the "First Offenders" program...And then I became a second offender for the same offense However, the cop told me that I had to just pay the ticket off (the second one) and all would be hunky dory.So I go to court the get the first one dismissed for doing the program, find out I have a warrant for my arrest bc I was-unlike the popo said-to attend my court date, and get two new court dates to get the whole mess settled out.Irony #2: One of the court dates is on my 21st birthday. The dilemma - if I get convicted of one, I am automatically convicted of the other.Any advice of how to get lucky and get them both dismissed? (I'm a bit stubborn and refuse to get a lawyer - or in any case try to get one of the lawyers at my job to cover my ass).

awesome first post!I'd get one of your lawyers to take the case for you (maybe even at a discounted fee) or if you don't want them involved get Crouch, because that man has pulled off some crazy shit.]
10/17/2006 4:03:40 PM
i think the bigger irony is that you are a criminology major....you should get a lawyer - preferrably one you know that will cut you a deal - i can't believe you asked advice on how to "get lucky"
10/17/2006 4:04:38 PM
i've heard of a few court stories that can be explained only as luck.
10/17/2006 4:08:47 PM

Good call - Irony #3: I'm a criminolgy major with intentions of becoming a lawyer, granted I can get my act together.Get lucky = Save my Behind. Wasn't meant to say that I don't deserve consequences for my stupidity, just that I'm praying for a miracle.
10/17/2006 4:11:13 PM
i've done a few pro bono cases for tdubbers before.
10/17/2006 4:12:49 PM
isn't the first offenders program dependent on the fact your don't get in trouble again for X amount of years?if you get a conviction, doubt that will look pretty on your law school application
10/17/2006 4:16:49 PM
10/17/2006 4:18:07 PM
For the first offenders program I was only to not get another offense in the 6 months until my dismissal date, which I moronically failed at.But yes, lawschool is my main concern with this whole ordeal.Perhaps I need to stop underestimating the situation and get a lawyer.

$texas question is will the DA throw out the First Offenders program due to the second violation?
10/17/2006 4:40:03 PM
If I get convicted of the second ticket, then yes, the first offenders program will be thrown out.And yes, thanks, I agree I'm being fucking stupid. Thanks for attempting to enlighten me of my stupidity though.I now intend to lawyer it up.

10/17/2006 4:49:14 PM
A drinking ticket is not that big of a deal on a law school application unless you're really on the borderline for admission.

10/17/2006 5:34:38 PM
how the fuck did you manage to get two drinking tickets
10/17/2006 5:47:41 PM
My insurance law professor pointed out that a police officer should never tell anyone to just pay a ticket. Technically, its practicing law without a license. Get a lawyer from your job to help you out. While you will have to put both the tickets on your law school and bar applications, it looks better to have it taken care of. Abonorio, I thought you were serious for a second. I was getting worried.

10/17/2006 6:26:42 PM
Either I'd do it, or the dudes would
10/17/2006 7:06:47 PM
3 drinking tickets, i winget mike dodd to help you, gives you half off ($250) if you go to state and i saw that man skip the massive line, walk up behind the bench, shake hands with the judge, and walk out with everything kosher
10/17/2006 7:07:41 PM
Go to student legal services...it's free legal advice if you're an ncsu student so you might as well use it and see what they recommend you do
10/17/2006 7:18:39 PM
They will just tell her to do the first offenders program. Her situation is a little more complex with the second ticket and failure to appear that she has.
10/17/2006 7:21:52 PM
Haha, for once I'm glad to be beat. I mean, I know I'm not a bad kid, I guess I just make stupid decisions, apparently But I'll be sure to give Mr. Dodd a ring-a-ding.My failure to appear has been wiped off, thankfully, because the cop had told me that I just had to pay and not go to the court date. Bad thing is, I already sent in my ticket cost and court fees for the second ticket, because the cop told me to. And by me sending it in, I apparently pled guilty (unfortunately didn't pay enough attention earlier and didn't find this out until I got to court). So now I'm confused as to whether the judge erased that plea by giving me another court date for the offense or whether I'm going to go to court and they're going to be like "What are you doing here? You already pled guilty"...Guess I still have a lot a learnin to do left in law school.Any thoughts?
10/17/2006 8:10:53 PM
Maybe your lawyer can ask the judge to overturn where you plead guilty by mailing in the ticket because you were acting on the legal advice of someone not licensed to dispense it. (a cop) It does however say right on the ticket that if you sign and mail it in you are pleading guilty so I dunno how thats gonna go over. Im sure once you call the lawyer they will tell you what they can do with it.
10/17/2006 8:21:51 PM
holy shit how can you be this stupid
10/17/2006 8:24:09 PM
1.) Don't ever mail in a ticket. I don't care what anyone else says, always bring it in with the payment yourself. I have seen more than one person get a "failure to appear" subpoena because their payment got lost somewhere in the mail and/or courtroom payment office.2.) Get a lawyer. You pled guilty by mailing the 2nd ticket in, and the only way you are going to fix this is by hiring a lawyer...preferably one that is friends with the cop and/or the judge that are involved in your case.
10/17/2006 8:27:26 PM
All you can do is learn from dipshit mistakes I guess...No more listening to the cops upon receiving a ticket.Wait, no...Just no more tickets.
10/17/2006 8:27:32 PM
how about you invent a fucking time machinethen go back and DON'T GET CAUGHT DRINKING UNDERAGEyou fucking samp
10/17/2006 8:29:41 PM
No more listening to the cops upon receiving a ticket.
10/17/2006 8:31:05 PM
haha, you thought that the cops would tell you the truth?cops are trained to lie to you to make their life easieryeah, just go ahead and mail this ticket in, and everything will be fine. hahah, this bitch isn't going to show up in court, and it'll be no contest
10/17/2006 8:33:50 PM
In all honesty, I thought it was just a fine, due to the fact that he just said that I had to pay it off and that everything would be fine. I did look at the ticket whenever I got it, but was upset and must have looked over the "now important facts". I sent in the money the next day, thinking that I was scott free.Sorry I'm not up to par on drinking tickets/citations/fines. The whole situation was much different from the first one I obtained, so I wasn't sure what the hell was going on. And I've never been in any trouble with the law before - so yeah, I was naieve and stupid. Maybe still am, but atleast I have to grace me with your almighty knowledge of the legal system.
10/17/2006 8:34:36 PM
what?
10/17/2006 8:44:09 PM
shoulda just been like walmart and other big companies. I AM PAYING THIS...BUT I ADMIT TO NOTHING!
10/17/2006 9:12:09 PM
don't listen to emce though... he hates cops. But he's right.
10/17/2006 9:50:14 PM
10/18/2006 9:48:29 AM
You went wrong when you believed what the cop said.Paying off a ticket = "guilty as charged" plea.
10/18/2006 12:38:51 PM
can you even change your plea after you plead guilty and pay the fine
10/18/2006 5:30:36 PM
10/18/2006 6:01:18 PM
Apparently you can change the plea - the judge gave me a new court date, and this was after she knew all that had happened...Or so I'm hoping
