"Assault and strike one another by fists at sidewalk of 5th and cotanche st., a public place making an affray to the terror and disturbance of other citizens. 6514-33(a)"I basically got in a fight, cops broke it up and nobody wanted to press charges. Anybody ever get one of these? And also, am I wrong in thinking that NC state has some sort of free legal aid for students or something like that?

^^^ Why would they reschedule if they don't drop it? I would talk to student legal services and see if they think there is anyway you can get it dropped or reduced to just a fine or something. Other than that just have it expunged. If you're going to have it expunged don't waste your money on a lawyer. You have to plead guilty, do 75hrs of community service (you have like 6 months to do it all) and pay $300 on top of court costs. A lawyer can't help with any of that, just save your money. Depending on where you do the community service you can get it done in about 25hrs of actual presence at the site. When you go to court you talk to an assistant DA before the judge, tell him/her that you want to do this and they will get someone from the program to come down and they'll tell you what to say to the judge. After that you'll go talk to the person who came down, they'll get you set up with a place to do the community service. Some places are much better than others. I recommend Lake Johnson (see comment about actual time versus time written on sheet). At lake johnson you'll get people on and off the boats, and occasionally walk around and pick up trash, there's not much and you're out of their sight for an hr or so. Just go home or somewhere to eat and bring back some trash with you. Not that you have to though since there are trash cans all around and they will never question what you did with the trash you found. It's usually college students working there so they are usually very lenient and willing to help you with hrs (especially if you say something to suggest you may not have time to get all your hours done on time). Typically 2hrs of sitting in a rocking chair=6hrs of community service.

^^^for instance if the other person doesn't show, they'll reschedule it up to like 3 times i think, then probably eventually drop it...Gammon is good because he used to be an ex-cop and he definitely knows people, which is helpful in getting the shit dropped if u have a clean recordand for the record, if you get it dropped, or do community service, you can get it expunged, if the judge is willing(i'm pretty sure they have to agree to expungement if you have comm. service, or either drop it).....bypass the damn ~$200 fee for expungement and do it for FREE through campus' legal services...it takes i think somewhere from 6-8 months for the paperwork to be processed and for it to be erased from your recordif you've had other charges or misdemeanor(s), then you cannot get it expunged[Edited on August 22, 2006 at 12:52 AM. ahh.. what you meant was; "the assisstant DA may just drop it. If they don't and the officer which gave you the ticket doesn't show up they'll have to reschedule it. If he doesn't show up after 3 times they have to drop the charge."that's correct, and you're probably right in assuming the cop isn't going to show up for this.Am i wrong in assuming that "dropping it" means they drop the charge thus it is not on your record? I've had charges dropped by the assistant DA just before going before the judge, they are not on my record. I know if you're found not guilty it is on your record as "not convicted". But if it's dropped it should not be on there at all, so no need to have it expunged. And you're saying if you get community service as punishment for the crime that you can use that as some sort of "time served" for getting the charge expunged and not have to pay the fees for expungement? I don't know for sure this isn't the case but it's difficult to beleive considering courts charge you for court fees even if you sign the ticket saying your guilty, send in the fine, and never use the court's time. I'd be surprised if they're letting people get by without paying expungement fees.bigstallion talk to student legal services and any other lawyer willing to give you free consultation. Hope the cop doesn't show up for court but be prepared to do some community service and shell out a few hundred bucks if you want it off your record. Find out what the lawyer would charge you, but paying a lawyer to handle stuff is probably going to cost just as much as getting it expunged yourself. Better to get the wallet hit once than twice for the same results. If the lawyer says he's 100% certain he can get it dropped, or some how get it off you record at no extra cost, then by all means go for it. If not, save your money and handle it yourself. It will be off your record in 6 months. (assuming you don't have a prior record as mrjaydubyoo said).[Edited on August 22, 2006 at 2:47 AM. Reason : cop]
