driving in traffic on hillsborogh and a RPD pulls me over says that my radio was too loud....i asked him about the law he said 50 feet away blah blah blah. I asked him "so you were 50 feet away from me when i passed you?" He said that he was 4 cars back and heard music. I said there was plenty of cars with their windows down and music on and so on. He says that he KNOWS it was mine. Finally I asked what gauge they used to measure the noise and he said it was just based strictly on opinion.

I dont have a system with bass in my car and i was in the middle of traffic with my radio on. anyone have a similar experience or know what i need to say when i get to court.....like what would happen if i went to court that day and plead not guilty and explained that it could have been any single one of the cars that were in traffic with me or that the officer said i he was 4 cars back.

i have never heard of this, it's pretty stupid imo especially on hillsborough st in a non-residential area.

how much is the ticket for, is it worth your time going to the courthouse to argue about it (i know the principle of the matter is probably worth going for)?

i asked him and he said worst case $110 court costs plus $50 fine...it just makes me mad that he basically said that you are going to have to go to court and pay a fine based on 1. his opinion and 2. that he "knew" it was my stereo from 4 cars back even though i was traveling in decent amount of traffic

not that it should really matter but i also was ticketed for a expired license...it expired on friday.

Do you have the factory radio, or just an aftermarket head unit?
I would fight it. How did he know it was you? That will be an important question.

next time just say, "im sorry, i'll make sure to keep my music turned down next time" instead of arguing with a cop who is obviously on a power trip

^^i actually didnt argue at all. I was polite and just asked him about the law. when he explained it to me i apologized and said that i wasnt aware of it. i was never rude or tried to have a power trip

after he explained i just asked if he was 50 feet away and what they used as a basis for determining if it was too loud. that is when he said it was just an opinion. He even told me he would let the DA/judge know that i was polite and helpful

i have an after market cd player

i am not arguing that i didnt have my music on b/c i did, it is just that he said he could pick my music out of traffic from 4 cars behind me and that it was just his opinion that it was too loud

he asked for my license and registration i told him about my expired license and said my music caught his attention....he never said it was too loud just that is what caught his attention. so i really didnt see any need to apologize

Get your license renewed and take it to court to get it dropped. When your there ask the DA if they will drop the other charge as well. If you have the time to fight it you might as well. The worst thing that could happen to you is you have to pay the fine which you would have to do anyway.

If they don't help you politely tell them to kiss your ass. If your going to have to plead guilty to a charge that cannot carry jail time you might as well have fun with it. I did this on a life jacket ticket once.

I got a ticket like this on Glenwood one day, but it got thrown out. He was an asshole though bc he said well ur car looks like the only one capable of producing music that loud. Whatever that means

I dont know how bad traffic was that day but its not that difficult to figure out where loud music is coming from. usually takes a few seconds but its dooable. And I dont know the tone you were using or if you ment it but you were being a smart ass asking him if he was 50 feet back and what instrument they use to gauge it. Im sure you were just curious but if you asked it like that I would have given you a ticket... even if at first I Was gonna give you a warning. Im just saying. you can plead not guilty if you want*good luck* but you better come up with something better then "it could have been someone elses car."

^ there is. IT's called a $9 sound pressure meter from Radio Shack.

This is a big issue around here. One person I know has been pulled over, and while I'm not legal advice this is what they did to not get a ticket and got away.

LET ME STATE, that most officers are good people and aren't assholes about this. They give you warnings and that's it. That is what is supposed to happen. Only if you are being OUTRAGIOUSLY loud will an officer cause issues. If you were this loud... take it like a man/woman.

Just as background both have base systems but neither ever plays them loud enough to vibrate their windows (IE too loud).

First one drives a Jeep with a soft top. He gets pulled over by a cop saying his music is too loud. He apologizes and asks the cop what is an acceptable volumn since he is in a jeep. Cop tells him it's not his job to tell him. The guy says yes it is.. blah blah blah arguement insues. The cop brings the ticket to the jeep and he refuses to sign it until he is told what is an acceptable volumn. Cop tells him that if he doesn't sign he's going to jail. Guy immediately calls his father who is a lawyer and his father tells him to have the officer call a supervisor. Officer gets really pissed off and the father tells him to tell the cop that "If you don't call a supervisor immediately then I'm going to call 911 and do it myself.".

Cop let him go.

Here's what YOU need to know about your rights when dealing with these.

1) The officer is REQUIRED to tell you what an acceptable level is in your car. This is not a choice. Though you can still recieve a ticket for it, he must inform you of the law and what an acceptable level is.
2) The officer is REQUIRED to contact his supervisor when he does not have equipment to measure the sound level IF REQUESTED. If the officer refuses explain your rights and call 911 if he continues to deny your rights.
3) GET HIS BADGE # if he refuses your rights. An officer of the law is required to give this number on request.
4) After you have his Badge # and have been told by the supervisor (who is not required to be on site), READ your ticket because some forms say "By signing this ticket you agree that you committed this crime". MARK THAT OUT.
5) When you have done the above, Sign the ticket. HOWEVER, when you SIGN the ticket, write on the ticket that the officer is getting that you "Disagree with this ticket and believe that your rights were not observed". This way the officer CANNOT argue that you did not argue with the ticket in court.

Again I am NOT a lawyer but this information came directly from a lawyer in NC.

i ussallay hit the mute or pause buttton when i'm at a light with a good amount of traffic bc again i bought my shit for my enjoyment not to force my chioce of music on evryone around me. anyway if you do have a "system" and the cop is more than couple cars away it should have been pretty difficult to determine if it was your car since bass below a certain frequency is non directional. so i'd say he had to have singled u out bc of the appreance of u or your car.
