can you get a dui on a bicycle?
12/3/2005 10:26:44 PM
if you are on a road, yes
12/3/2005 10:27:13 PM
what about on a sidewalk?
12/3/2005 10:28:23 PM
I saw one on one of those COPS videos shows when I was flipping through the channels.
12/3/2005 10:29:11 PM
bicycle is a moving vehicle and obeys traffic laws so yes u can
12/3/2005 10:29:20 PM
i was just wondering how you could get one without having to have a driver's license or insurance to ride a bicycle.
12/3/2005 10:31:31 PM
good point....hmm
12/3/2005 10:39:59 PM
I knew a guy who got one in a golf cart once.
12/3/2005 10:40:50 PM
its a DWI, i learned that in my alcohol abuse class today, apparently they did away with the DUI name
12/3/2005 10:50:03 PM
no you can nota bike must follow the rules for motor vehicles when on the road but does not count as one for dwi
12/3/2005 10:54:05 PM
dui can only happen on a MOTOR vehicle. If you're riding a bicycle (not motorcycle) then you can't get a dui... a public intoxication yes... but not a dui.
12/3/2005 10:57:04 PM
Dave Grohl (from Nirvana and Foo Fighters) got a DUI on a moped or something a few years agothink he was in australia or somewhere
12/3/2005 10:59:15 PM
actually i could be wrongi swear i remember reading that but now i cant find ithttp://www.ncdot.org/transit/bicycle/laws/laws_bikelaws.html
12/3/2005 10:59:53 PM
no way, you could get a drunk and disorderly .. its not a registered vehicleyou can get a dui on a horse though, cause that has to be registered
12/3/2005 11:37:23 PM
If you can be drunk enough for a DWI and still be able to balance on a bike, you are too damn good for a ticket.
12/4/2005 12:06:10 AM
if you cant ride a bike with a .08 you lack basic motor skills
12/4/2005 12:07:30 AM
What about a moped?
12/4/2005 1:39:46 AM
mopeds are fun to ride till your friends find out.wait, you are referring to unattractive party sluts, right?
12/4/2005 8:39:39 AM
YES you can. my brother got a warning ticket from a cop a few years back he was riding up at a shopping center. the cop was really nice and joking with him and stuff, but still made his point clear.you can get one on a horse too.
12/4/2005 10:41:33 AM
if that is the case, any violation or ticket would not affect your license since you are not required to have a license to ride a bike ... it would only be a misdemeanor
12/4/2005 11:08:07 AM
You can NOT get a DUI on a bicycle. You CAN get a drunk and orderly or a public intoxication on one. If you don't believe me go ask a cop. It was an arguement I had with someone years and years ago so we got the cop on duty to look it up. You do not have to have a license to get a DUI. IE, if you're driving a golf cart and you're drunk. So stop argueing with me when you don't know wtf you're talking about.
12/4/2005 11:15:02 AM
i think you can, but its prolly like getting one on a boat, where all it does is cost money, theres no license to lose or anything like that.
12/4/2005 11:59:14 AM
can you get a DUI if you are riding on someone piggyback?
12/4/2005 11:59:27 AM
i think the DUI should go to the person giving the piggyback ride
12/5/2005 2:18:58 AM
how bout hanggliding?
12/5/2005 2:34:56 AM
12/5/2005 12:28:11 PM
in NC bicycles, lawnmowers, and horses are not considered "vehicles"
12/5/2005 1:31:51 PM
i got pulled over once for drunk driving my horse
12/5/2005 1:43:39 PM
i was just about to post that you can even get a DWI for being on a horseshit you not...^^you must not have seen the case law on that one then[Edited on December 5, 2005 at 1:57 PM. Reason : ][Edited on December 5, 2005 at 2:03 PM. Reason : w]
12/5/2005 1:56:54 PM
the lawnmowers thing is wrong bc i know of someone that has gotten one on a lawnmower, as sad as that seems. and where did u get this information that a bwi goes on your drivers license? i think all they do is take you to jail and costs u buncha money, nothing with your drivers license.
12/5/2005 2:00:38 PM
^^dangit I think you're right...but I need to look into itthey aren't considered vehicles, but the law might still apply. I checked my NC Crimes and my MV Law, but I hate how that crap is written...plus, it doesn't have all the recent case law so I might be missing something...now if you're riding a cow, that's another matter
12/5/2005 2:24:32 PM
can you get one riding a camel or a flying carpet?
12/5/2005 2:33:51 PM
yeah--the ONLY reason why i know it's in the case law is cause it was part of my homework assignment for legal research like 2 weeks ago, haha. the question was "what's weird about blahblah v. blahblah?" and the answer was he got a DWI while on a horse which was considered a vehicle by blahblahblah case law i'll post what case it was when i get home and can get to my notes[Edited on December 5, 2005 at 2:34 PM. if only there was a tool that could "search" the internet for certain keywords or phrases like "bicycle dui"
12/5/2005 3:37:45 PM
how bout sledding downhill drunk when it snows?
12/5/2005 3:38:32 PM
???
12/5/2005 3:56:00 PM
I know a few years ago (and this came from a Marine Patrol Officer)-- you can only get a DUI on something that has a motor associated with it (moped, golf cart, lawnmower, scooter with a motor). For anything else (bicycle that you pedal, etc) you could only get a drunk in public, etc. As for the BWI...again, this was a few years ago, in NC, it would not affect your driver's license. The way he told me, you basically just cooperate, put out your hands so you can get cuffed and stuffed, they take you to jail, process you, you pay some money, and you're done. This was about 5 years ago, so laws may have changed since then.

Bicycles on a highway? uh in North Carolina it's illegal to ride a Bicycle on a highway period. Ask any Hwy patrol or Cyclist who rides in events.

State v. Dellinger, 73 N.C. App. 685, 327 S.E. 2d 609 (1985)and the statute is:"Vehicle" as used in statute defining offense of impaired driving includes a horse, in light of statute making traffic laws applicable to persons riding animals upon a roadway. G.S. §§ 20-138.1,
12/5/2005 9:05:53 PM
You can get one on a bike, and until recently a horse. About a year or two ago the supreme court ruled you could not on a horse, because the horse would compensate.... But you don't have to have a Drivers license to get one on any vehicle, just as you can get one on a boat, you just don't lose you license, or have an insurance penalty....
12/6/2005 8:12:18 AM
12/6/2005 8:19:09 AM
^^where do you get that the supreme court said you can not get a dwi on a horse? according to westlaw the case i just cited is still good law...the statute as well. and westlaw online keeps things pretty up to date.
