I'm pretty sure the law will not shine upon this woman in favor. I don't know if Lonesnark is correct about Texas, but shooting in defense of property is not legal in North Carolina. For shooting somebody to be legal in North Carolina, the suspect would have had to have threatened her, preferably physically as opposed to just verbally. If the dude had pulled out a gun or a knife, the lady would have a much better chance, but as far as I can see it looks pretty bad for her legally.In North Carolina (and in probably most other places that don't completely ban guns), there are four questions that have to be answered before the legality of a shooting can be decided: 1) was the defendent in immediate mortal danger? 2) would someone else of sane mind have done the same thing? 3) did the defendent use excessive force? and 4) was the defendent the instigator of the confrontation?From the info we have, I'd say that 2, 3, and 4 are probably covered, but she's not kosher with regards to 1. That is why I feel that she's probably going to get into legal trouble. Well, I have been searching, and some states make accomodation of deadly force to prevent a felony. In NC this is manifest in the legality of deadly force to prevent armed robbery. But I don't know if grand-theft auto is a felony nor if NC makes such accomodation.

vigilante justice is a double edged sword.there was some old charles bronson movie about this guy that starts killing muggers after one kills his wife and daughter or something. the crime rate went way down and the cops were scared the public would find out.

I've had two tickets in the last 4 months. One 16 over and the other 10. The second ticket was actually 15 over but the female cop from winterville gave me a reduction becuase she felt sorry for me. Police are taught to eliminate a percieved threat before deadly action should take place. Its a shame that we even have to talk about things like this.The woman had her property stole in front of her face. The only way she probably could have stopped him would have been to shoot him. It was a lose-lose situation for her. She could have either let the guy steal her car, or shoot him and face what she is now. If the shot would have not been lethal, then the criminal probably would have got a month in jail, then he could have pressed civil charges ect. against Peele. The laws are way way way way way to loose on situations like this.

I'm not saying ALL cops are sadistic killers. just most of them have a hard-on to use their gun, thats all. out of the cops I know, three of them have killed people, in and out of the line of duty, and the other two talk about the "what if" they had to situation quite alot. While it is something you have to consider if you're going to be in law enforcement, you don't have to do it gleefully or talk about it. When you have killed someone, you tend to think about doing it quite differently than you do had you not. It changes you. Taking a human life is a powerful thing and not something that you would think one would want to do. However I can understand how holding that much power in ones hands could make someone want to use it.
