whats even more sad is this happens all the time, b/c punishment for lying is not even close to the punishment for being accused of rape

I would be pretty uncomfortable being the only black dude on a team with 46 other whitefolk.

Then again, it is lacrosse.

"The New York Times and Raleigh News & Observer reports that the same day Finnerty was ordered to submit a DNA sample in connection with the investigation, he was in Washington D.C. to face charges of simple assault. Finnerty and two friends were arrested early Nov. 5 after a man told an officer that the men allegedly assaulted him. They reportedly called him gay and derogatory names, busting his lip and bruising his chin, according to court records."

So not only A) were not all 46 of the accused player's DNA taken but B) the one that didn't have his DNA taken that day was on trial for another assault charge. So "this guy's life is ruined" because he ruined it himself.

This story keeps unweaving into different directions. It shows that we don't know exactly what has happened and that all sides aren't revealing what went down that night.

Duke University lacrosse players Reade Seligmann and Collin Finnerty were charged today with first degree forcible rape, first degree sexual offense and kidnapping in connection with a reported rape at a Duke lacrosse party, according to George Naylor, director of the Durham County Jail.
Bond was set for each player at $400,000, Naylor said.

Seligmann, a sophomore from Essex Fells, N.J., and Finnerty, a sophomore from Garden City, N.Y., emerged from a sheriff's deputy vehicle and were led, handcuffed, into the magistrate's office at 4:54 a.m. today.

Just after 7 a.m., Seligmann and another man left the jail and ran to a Ford Explorer with New Jersey license plates. They pulled onto Pettigrew Street and went to the traffic light at Pettigrew and Mangum streets. They stopped at a red light, waited for traffic to clear, and then turned left, running the red light.

Seligmann and Finnerty's arrests stem from a party that began March 13. The accuser, who is a mother of two, an N.C. Central University student and an escort service dancer, told police March 14 that she was sexually assaulted by three men in a bathroom at an off-campus house shared by three lacrosse team captains. The accuser is black; she said her rapists were white.

Kirk Osborn, Seligmann's attorney, said, "We're looking forward to showing that he is absolutely innocent as soon as we can."

Defense lawyers said players maintained that there was no sex at all. They said the accuser concocted the story, that she was drunk and injured late March 13 when she arrived at the three-bedroom house at 610 N. Buchanan Blvd.

"... Two young men have been charged with crimes they did not commit. This is a tragedy," Bob Ekstrand, who represents team players, said Monday in a prepared statement. "For the two young men, an ordeal lies ahead. They do not face it alone; they face it with the love of family and friends and strengthened by the truth. They are both innocent."

Superior Court Judge Ronald Stephens sealed a manila envelope containing the indictments shortly after the grand jury finished its business Monday. The judge cited a state law that requires everyone involved in a case, including witnesses, to keep the indictment secret until a suspect is arrested.

Last month, a judge ordered DNA tests on the team's 46 white players; he excluded the only black team member. The players' attorneys say the tests showed none of the players' genetic material on or in the woman.

Nifong, bolstered by a medical exam that found injuries on the woman consistent with sexual assault, says he is confident that she was assaulted in the university-owned house. Nifong said last week at a forum at NCCU that the accuser identified at least one of her attackers.

Until Sunday night, the only other witness, the second woman hired to dance at the party, had remained silent. In television interviews, she told her story.

The woman's attorney, Mark Simeon of Durham, declined Monday to make her available for an interview. She spoke on the MSNBC cable news network, which did not identify her and showed her in silhouette. Simeon confirmed that it was his client on MSNBC.

The woman told MSNBC that she did not witness a rape and does not know whether one occurred.

The woman said she arrived thinking that she would be dancing at a bachelor party of 15 people. She was not expecting a party of lacrosse players, many of whom she said were in a drunken stupor. The woman said she was infuriated to learn that some players photographed her dancing.

The accuser did not appear to be on drugs or to have been drinking when she arrived, the second dancer said. She was "absolutely fine and in control of herself."

When the accuser left, less than an hour after she arrived, she was incoherent and stumbling, the second dancer said.

"She couldn't really walk on her own," the woman said. "She really couldn't get her thoughts together enough to answer any questions. ... She was a different person than I met at the beginning."

The second woman said she was the person who called 911 as the party was breaking up, to complain that some lacrosse players had used racial slurs. "The boys hollered the 'N' word," she said. "I was upset and called 911."

She said she pretended to be a passer-by because she didn't want people in her life to know about her job as an escort service dancer.

It is unclear how that woman's story would affect the case. Players' attorneys have said she would only help them. By day's end Monday, Nifong left without talking to reporters; it remains unclear what evidence he has.

Throughout Monday, there were many more reporters on the sixth floor of the courthouse than the 18 members of the grand jury panel. Reporters tracked the district attorney's movements in minute detail. Just after noon, Nifong emerged from his office and walked across the hallway to the bathroom.

Reporters surrounded the bathroom door in a crowd that included five television cameras, three still photographers, sound men with boom microphones and at least a dozen print reporters. At the sound of flushing, the group tensed, raised cameras and prepared. Nifong did not emerge with news.

"I no longer get to go anywhere in my community without people knowing who I am," said Nifong, who faces two challengers in a primary election May 2.

the father of two players speaks out:

Quote :
"April 18, 2006 — When Brian Loftus heard his twin sons were not the two Duke lacrosse players indicted by a grand jury today, his first reaction was relief, the second despair.

"I got word that my two kids weren't two of the kids being indicted. It was like, you know, one of those bittersweet things, a relief," Loftus told ABC's Chris Cuomo in an exclusive interview. "But right now, I'm sick to my stomach. … I'm not an emotional person, but I was crying earlier today because those two kids' lives are ruined, I mean totally ruined. For the next six [months] to nine months, they're going to be scrutinized as criminals and I know these kids. It's the furthest thing from that."

Duke sophomores Collin Finnerty from New York and Reade Seligmann from New Jersey turned themselves in this morning. They are charged with first-degree forcible rape, first-degree sexual offense and kidnapping. Lawyers say they're charged with crimes they didn't commit, and Loftus, who lives in Syosset on New York's Long Island, said his sons had been telling him the same thing ever since a stripper told police she was raped at a party thrown by Duke's lacrosse team more than a month ago.

"Both my sons vehemently, all they ever told me was, 'Dad, nothing happened. Nobody did anything,'" Loftus said. Loftus added that the "Blue Wall of Silence" was a myth, and that all the players were willing to cooperate with authorities.

"These kids were willing to take polygraphs. These kids were willing to take blood tests. They were willing to come down and give statements," Loftus said. "They did everything. They gave their DNA. We thought once we give that, that it was going to be over. … But every night, every day, all we see on the TV is, we're hiding something. Obviously there's nothing to hide."

Loftus was one of the New York firefighters who responded to the Sept. 11, 2001, terror attacks. He said he was also bothered by media reports calling the lacrosse team a bunch of rich, white kids whose only possession greater than wealth was cockiness.

"I'm not an emotional person, but every day I cry. I have tears in my eyes. I feel like the world's been pulled underneath my feet," Loftus said. "My kids, when you hear them sobbing on the phone that their lives are destroyed and you hear other people saying the same thing you wonder what went wrong. And we know nothing went wrong. I cannot stress that any more. Nothing happened that night."

I mean I'm looking at both sides of the story here. If these two kids have to have their face plastered across the screen, their families accosted, etc, then their accuser should be made public too. Either do this entirely behind the scenes or entirely in front of it.

^^ Bail doesn't really work the way you probably think it does (based on your statement)..

In their case, the parents/friends will goto a bail bondsman. Essentially they will loan you 400,000 dollars for (I'm making this next number up) 10,000.

If you *don't* flee then you will only owe the courts (again, making this up) 8,000 dollars. If you do and you are caught, then you owe the full amount of the bail. This is the 'bet' the bail bondsmen make: Weighing the risk of your flight (and your ability to pay them back in the case you owe the entire bail amount) against how much 'extra' they are going to charge you to loan you the bail money.

You usually pay 10% (of set bail) or whatever the bondsman wants. You never get that money back. However, you get to be free while awaiting trial. If you actually do have the money to pay all of the bail then you won't lose the money as long as you don't flee.

Exotic Scholarships?
Quote :
"Rev. Jessie and Rev. Al want to get behind this stripper -- and who can blame them? A lap dancer is a terrible thing to waste. But in the interest of fairness, shouldn't we provide scholarships for ALL the strippers and exotic escorts?

Black, White, young and old, ALL of these adult entertainers deserve our support, and together we can do it -- even if it's just a dollar or two at a time.

I'm all for giving a bump to those forced to grind, but these ladies shouldn't have to allege a gang rape and tear the community apart to qualify for such a scholarship."

Its not illegal to give out her information, but it is very much frowned upon. But any idiot who knows what he's doing can figure it out since her record isn't clean. her stealing a Taxi outside a strip club called Diamond girls in Durham, in 2002 made it easy enough to find her name.

there are 47 lacrosse players on Duke's team. 1 of whom is black. Since the girl said that her attacker was white then simple elementary school math would tell us that there were 46 accused players (47-1.) WRAL (this morning anway, i haven't checked back yet) said that at least one of the 46 players accused did not give DNA because he was on trial in D.C. the day that the testing went on. So I do know what I'm talking about.
