I do agree that we need an enemy combatant classification, and frankly one has always existed. If attempts against life or property are committed by an agent of a foreign government, they would be held as a prisoner of war, and tried in military courts. They would not be subject to our constitutional rights, but would be afforded the protection of the Geneva convention. (Ideally, but I guess that's another argument, that we aren't meeting that)

The enemy combatant classification gives leeway for acts committed by quasi-government organizations (or those operating harmoniously with foreign governments) (al qaeda, Hezbollah, etc), to be interpreted as acts of war, and thus the perpetrators would be tried in military courts.

Frankly, this isn't the case. Maybe there was another layer of accomplices, but its hardly a network of people. Its obviously a civilian court issue, just as McVeigh was. The color of their skin, or their religion, does not make them an agent of a foreign government.

^ they were both US citizens on US soil, I can't envision ANY scenario where they wouldn't be processed under the "normal" justice system.

It was a fiberglass hull, i'm doubtful those are less-than-lethal rounds. And you can see at least some of them exited the other side.

^6 can't envision any scenario? We imprisoned Japanese american citizens during world war 2. Suppose a Japanese immigrant with us citizenship blew up a crowd. would he be tried as a war criminal or in civilian courts? Suppose they claim they were acting as agents of the Japanese government?

It doesn't sound so far fetched. I don't think this reaction is anything new in our country.

Exactly why they'd likely have been tried in a military court for killing civilians.

To be clear, I'm not advocating this be the situation in this case... Just pointing out that this idea isn't so far fetched, IMO.

^^^i think its pretty universally held that Japanese internment camps were a low point in this countries history, and we should never let it happen again.

Also treason is typically tried in federal court not military.

It is funny how people say "they hate us because of our freedom" and then turn around and want to take away our freedom. Sorry folks the guy is a US Citizen and as inconvenient as it might be he has the rights of one. He has the right to remain silent and the right to a fair trial. These people claim to be patriots yet they have no faith in the Bill of Rights. This guy isn't going to walk. I am pretty confident of in this. I fear a police/neo fascist state rising out of terrorism more than terrorism itself.

And the older one, he had a wife and a 2 year old... did he think about them? If he hadn't died, what was his plan? To live as a fugitive for the rest of his life, away from his family? Cuz surely there is no way you can't get caught, even if you weren't at the scene, not in this day and age.

As I said earlier, anybody who kills innocent people like that should be executed.

Also, civilians talking about enemy combatants make me laugh. Im here, and we dont know who the fucking "enemy combatants" are until they pull some shit! Then they know exactly what to not get shot at! Trust me, I would love to see these boston bastards be called enemy combatants, but since when has a politician EVER got it right with naming the enemy or setting rules of engagement? Since when do civilians know so much on the law of land warfare? Its alot more complex than most realize, you just dont call someone a bad guy then play by a different set of rules. It affects things from the big picture of international politics all the way down to some Joe on patrol pulling the trigger, and it goes back into past actions and speculations. I am alllllllll for it to label anyone who works with, listens to, trained by or associates with AQ or any other terrorist network, but I dont think it can work along side our American rights. You would have to have 1 dude, judge case by case, if a guy is the enemy or not, and there is no human, and will never be any human, that can be impartial to the degree required to fill that role. (not even me, and im awsome )

wolf2ranger is pretty right on. But I think I take issue with being told guys who aren't in the military have no business doing anything because "they just don't know" (which, honestly, being in the sand, dealing with political forces at the ground level and waiting for the next crab-juice salesman to blow himself into pink mist is something I DON'T know about and hopefully never will)

It unsettles me for the primary reason that DHS has so thoroughly remade the "rules" that I'm not sure military dudes can readily "turn it off" when dealing with situations back home, and diminishing the value of resident citizens of your own country
I suppose it has a great deal to do with the isolationism forced on the military post Korea and the downright hostility they faced from liberals back home during Vietnam.
It changes the "Us" in the "Us vs Them" I imagine is required for solid teamwork in the highest stress environment, from "Us, the Americans" but "Us the Military" vs "Them, the non military"

Twitter is saying the Saudis warned the US about Tamerlan too. DHS says this never happened.
