He has to already have a subpoena ready for anything the defense challenges for all of his witnesses and evidence. For every piece of evidence he needs to have a subpoena ready for someone to confirm their authenticity. Moat evidence wouldn't be challenged, but if he didn't have a subpoena and the defense challenged it he would be SOL. Basically it just means he's serious about prepping for a trial.

if the order stopped at part b his questions might put the investigation in jeopardy, but it continues with part c that says:

The charges are federal crimes, the arose from the above investigation, therefore it seems pretty clear that he is authorized to prosecute them if he believes it necessary and appropriate.

also, if thrown out mueller would just hand the case to the us attorney who can still put pressure on manafort
