Lawlz. Why not just go the fuck someplace else. It's not the only sport bar in town. If it did happen, 2 tears in a bucket. They can refuse to serve people, BFD. I can't see wasting my time protesting bullshit that I don't even know actually happened. Knock yourselves out though.

The Civil Rights Act of 1964 prohibits businesses that provide public accommodations engaged in interstate commerce(read: all stores, restaurants, hotels, theaters, etc) from excluding patrons on the basis of race, color, religion or national origin. Protection for individuals with disabilities was added later, but conspicuously absent from the above list is sexual orientation...the owner can paint "NO FAGS" on the front of the store and be in compliance with the law.

Private clubs are, of course, excluded, but it is my understanding that this establishment is not such a club. Could Sam's Club or BJ's could also discriminate based on race? I'm not sure if a private "club" with millions of members really counts.

---------
Answer: no. Even bars and stores that are "private clubs" are not exempt from the Civil Rights Act.

Quote :
"Following the passage of the Civil Rights Act in 1965, dozens of businesses and facilities – including swimming pools – tried to argue that they were "private clubs" so that they could exclude African Americans. The courts quickly developed a test to distinguish between truly "private" organizations and those that only claimed to be. Very few facilities qualified as truly "private."

In order to be exempt from the civil rights laws, a "private" club must truly reserve its facilities for members, and must have genuinely exclusive membership criteria – a club that will admit anyone who is not African American does not qualify. Courts deciding whether a club is “private” in this sense will consider the history and purpose of the club (including whether it was created to circumvent desegregation), the club advertises for members, it is directly controlled by its members and operated solely for their benefit, and the club is operated for profit.

Membership in the Valley Swim Club is generally open to the public. Therefore, it is a "public accommodation" and not a "private club" under federal and state civil rights laws."

On the other hand, a biker bar that exists solely as a hangout for the use of members of a biker gang, that doesn't let just anyone sign a list and walk in, would likely be exempt.

So...what's this protest going to involve? Blockading and attacking people when they try to go in the bar?

and did they really have to call it an "Occupy" event?

No plain tees. All tees must be accompanied by a large screen printed dragon or skull. Preferably in shiny silver ink.

"^^ that's quite idealistic, especially in the south. Reality is that the vast majority of its patrons either won't know or won't care. Do you really think the average 21-24 year old white kid from NC cares one bit if a bouncer discriminates against blacks?"

Word is getting around just fine. People will associate DTSB with this incident for years to come regardless of any staff/policy/ownership changes. As for the ones who "won't care"; you can't legislate morality. If certain groups of people decide this bar's management and patrons are representative of their own values then let them have it. I'd rather them be there than any of the bars I might choose to visit.

So if they start enforcing their "membership policy" down to the letter are the servers all going to quit, its hard to make money working at an empty restaurant.

yep, had a friend go last night. he said he had to sign some membership thing at the door. he also said there weren't many people there last night. although, that may be typical for a wednesday, I'm not sure.

As mentioned above, a membership signup at the door is not sufficient to exempt them from Title II of the Civil Rights Act of 1964. If black individuals can establish a pattern of discrimination, perhaps with hidden cameras, they absolutely will have sound basis for a lawsuit.

They are not going to fuck up again, their spot is blown up. I am sure the owners have been spending a lot of quality time with their attorneys the last couple of days trying to figure out how to minimize the fall out.

A non-confrontational business owner would probably fire the guy and not say another word.

The only reactive action we know of is that they implemented a membership policy. This might make sense inasmuch as the owner is bracing for a protest flooding the bar with people, in which case they can tell them all to fuck off. The basic problem can still be there in terms of giving memberships to white people and not to black people. Presumably the bouncer is still just as racist as ever, but knows of the attention they got.

They could always just close for a week and change their name and count on the fact that the average patron of Glenwood South bars is too stupid to figure out their ruse.

the ONLY problem i've had with this whole thing was his proclamation that this was "just like 1960, only with a worse economy."

i'm sorry but i don't think he quite grasps how different this is from 1960, and what people in 1960 actually had to go through on a daily basis, aside from just getting kicked out of a bar for being black.

by all means, this situation is shitty and what happened was fucked up... but it's not like pre-civil rights era south by any means, and he cheapens the struggle by comparing his story to that.

They don't have a time listed anymore, even though they have 115 rsvps. I'm curious how the march down Glenwood would work. In the day? At night? What exactly are we talking about here?

Apparently CNN has called the people in the group and will be covering it.

According to their FB event page, a lot of celebrities and CNN will be covering the protest.
I'm quite surprised at how much publicity and media attention this one incident has received.

I honestly thought it would be a simple local news story resolved by he said vs he said.

There is racism prevalent everyday. Can someone enlighten me on why this particular incident is catching so much worldwide attention?

Read the news story. Whatever group is pushing this claims to have 20 black people who say they were discriminated against by DTSB, all of whom are putting their name behind the claims. That established, I think the national conditions and state of the media has probably been waiting for a story like this. It's not unique, it's unique that it happened now, and that it made it to the well-circulated blogs.
