The Civil Rights Act of 1964 prohibits businesses that provide public accommodations engaged in interstate commerce(read: all stores, restaurants, hotels, theaters, etc) from excluding patrons on the basis of race, color, religion or national origin. Protection for individuals with disabilities was added later, but conspicuously absent from the above list is sexual orientation...the owner can paint "NO FAGS" on the front of the store and be in compliance with the law.Private clubs are, of course, excluded, but it is my understanding that this establishment is not such a club. Could Sam's Club or BJ's could also discriminate based on race? I'm not sure if a private "club" with millions of members really counts.---------Answer: no. Even bars and stores that are "private clubs" are not exempt from the Civil Rights Act.

As mentioned above, a membership signup at the door is not sufficient to exempt them from Title II of the Civil Rights Act of 1964. If black individuals can establish a pattern of discrimination, perhaps with hidden cameras, they absolutely will have sound basis for a lawsuit.

A non-confrontational business owner would probably fire the guy and not say another word.The only reactive action we know of is that they implemented a membership policy. This might make sense inasmuch as the owner is bracing for a protest flooding the bar with people, in which case they can tell them all to fuck off. The basic problem can still be there in terms of giving memberships to white people and not to black people. Presumably the bouncer is still just as racist as ever, but knows of the attention they got.

the ONLY problem i've had with this whole thing was his proclamation that this was "just like 1960, only with a worse economy."i'm sorry but i don't think he quite grasps how different this is from 1960, and what people in 1960 actually had to go through on a daily basis, aside from just getting kicked out of a bar for being black. by all means, this situation is shitty and what happened was fucked up... but it's not like pre-civil rights era south by any means, and he cheapens the struggle by comparing his story to that.

According to their FB event page, a lot of celebrities and CNN will be covering the protest.I'm quite surprised at how much publicity and media attention this one incident has received.I honestly thought it would be a simple local news story resolved by he said vs he said.There is racism prevalent everyday.
