i think that they should make a warning DUI for people 21+cop pulls you over... and if he/she smells alcohol and you blow ANYTHING at all, you have to get one of those machines. even a .02 -- i mean .04 is half drunk, right?it's like the commercial says... buzzed driving IS drunk driving. most people don't consider themselves DRUNK until they're at like .15, and that's a facti think that anyone who shows that they will drink even one drink and get behind the wheel is a liability and should be forced to install one of those. hell, any responsible person would WANT something like that, just to make sure they don't ever drive drunk on "Accident" after having some wine with dinner.(i know you all know someone who has had a DWI after only 2 liquor drinks)ps - anyone who says that addiction isn't a disease is fucking delusional

It seems like most people who ever consider driving drunk are far more concerned about the police than they are actually hurting anybody, because of course they think they can drive just fine. But no matter how well you can drive, you can still run into a checkpoint or otherwise run into a cop. It's hard to increase the police's ability to catch drunk drivers, but it's damn sure possible to increase the consequences when they do.Reduce the legal limit to, say, .06. For the first offense, take away their driver's license for ten years. For a second offense or driving without a license, no less than two years in prison and license revoked for life. A truly zero-tolerance policy like this makes the consequences more expansive and severe in a way that I think would play very strongly in the mind of a potential drunk or buzzed driver and dramatically reduce the incidence of either.

As with anything some people get arrested who probably shouldn't have and others don't get arrested who probably should have been. The people that are barely over the limit and get popped really are no danger to anyone unless they are inexperienced drinkers and their bodies have 0 tolerance. The people that you usually find out that killed some one are the people that would blow a .19 on a Wednesday morning (over exaggerating). But there has been studies that show people that are slightly sleep deprived are much worse drivers than those who are slightly over the legal limit. Now those who have been out till 3am and have been drinking have the combination of sleep deprivation and alcohol that is a compound problem which also makes them horrible drivers.All I'm saying is you're giving people with no malicious intent charges that imply malicious intent.I also have an issue with the consistency of how alcohol is viewed by the government. A person can claim rape because they were too intoxicated to know better. But a drunk driver is always responsible for their actions.... I don't care which way it goes but please keep it consistent either you are or are not responsible for the poor choices you made while under the influence.]

I think they should change it to something like .12 and if you blow it, you lose your license for 10-15 years without any classes or anything.I'm pretty sure that I'm more aware and safe with .10 than a 16yo girl with a cell phone - and there fewer people on the streets.It's obvious the person lacks self-control and/or reason, this will make them remember that the government controls the roads and it is his or her privilege to drive on them.Of course this would never work, because it would instill the mindset that a person could drink more than they could have previously and still drive.[Edited on August 24, 2008 at 10:15 AM. ^^I'd hate on the state before the illegals. Illegals are going to drive with or without a license. How many times can you get a DUI in this state? How many times is the sentence reduced in court effectively getting rid of the punishment? I recently heard a story on WRAL (IIRC) where they reported that of 60 some odd DUI tickets they handed out during one of their crackdowns 40 or so were dropped before they went to court. What does this state do with repeat offenders? Repeat offenders would drive with or without a license as well, but what would they do with them when they are caught?I'd like to see a few statistics. Yeah they just changed all of the laws to make it a lot harder to get off a DWI last year. If you blow over .08 there is not much else of a defense they could present.

I just had the opportunity to convict a drunk driver while serving jury duty today. I'm glad I had the opportunity, and I'd do it again. It was his 3rd offense, and they put him away for 2 years.
