According to the 10-page lawsuit, the ACC said the school must pay $52,266,342, which is three times the league’s annual operating budget for the 2012-13 season.

The Associated Press obtained a copy of the lawsuit filed Monday in Guilford County Superior Court.

In a statement, Commissioner John Swofford says the ACC’s council of presidents unanimously decided “to file legal action to ensure enforcement of this obligation.”

“We continue to extend our best wishes to the University of Maryland; however, there is the expectation that Maryland will fulfill its exit fee obligation,” Swofford said.

The league raised its exit fee to roughly $50 million in September after adding Notre Dame in all sports except football. The exit fee is three times the league’s annual operating budget so it could fluctuate from year to year.

Maryland was one of two schools that voted against the increased exit fee. Florida State also voted against the increase.

Brian Ullmann, Maryland’s assistant vice president for marketing and communications, didn’t immediately return a call for comment Tuesday afternoon.

The ACC twice increased its exit fee in the span of a year. The fee was around $12 million to $14 million before the league announced in September 2011 it would add Pittsburgh and Syracuse from the Big East, which led the league to up the fee to $20 million.

But Maryland President Wallace D. Loh told The Washington Post he voted against the increase connected to the Notre Dame move because he thought the higher fee was “illegal and philosophically not a good idea.” He also called it an “exit penalty.”

Maryland is scheduled to begin Big Ten play in 2014."

screw maryland. ideally, i would like the acc to stay as-is, but maryland can be replaced. several teams are vying to join the conference. i really don't understand the fear of the ACC dissolving.

it's the big east that's ultimately getting screwed...all the good teams will make their way to the other major conferences, and all that will remain are the lesser teams and imports like ECU.

^Agreed! The ACC isn't going anywhere. It's not the top league in football right now, but it never was anyway. Unless the SEC, Big Ten, and Pac-12 all decide to go to about 20 teams, then there will always be an ACC. Some people are just a little too excited about SEC sports and also can't count.

^ four 16 team leagues and the ACC likely loses its AQ status eventually. But that isn't happening for a long time.

Louisville is good choice based on recent two sport success and they have a rabid fanbase. ACC no longer cares about academics, which is nice to see, though I'm not sure which of UVa, Duke and UNC voted for all of a sudden. Biggest downside is their tiny TV market (500,000 - ranked 50th in country).

I dig it, but for a different reason. Apparently the ACC pissed the B1G off when we took ND, so they took MD and Rutgers as revenge for us constantly invading their "territory". Louisville is in SEC country, so maybe they'll respond by courting us and VT (its happened before when we "invaded" with GT and FSU, though they did take SCar).

While the ACC is a viable conference and not going anywhere, it may soon be left out of the "Power 5" when it becomes the "Power 4". Either the Big XII or ACC are going to collapse football-wise; with the Pac 12 needing 4 teams, I see the Big XII being the one to eventually collapse, but you never know in this climate. The 3 safe conferences are the B1G, the Pac 1X, and the SEC. I'd rather take my chances with a sure thing.

I don't know that Louisville is "SEC country." It's across the river from Indiana.

^ why? UL is a good athletic program but a terrible academic school. Pretty self explanatory.

Eh, it's in Kentucky, that might be enough.

and if FSU leaves, that's it. Our only "football school" would be Clemson, and they'd leave with FSU (to I'm guessing the Big XII). That leaves UNC and UVA ripe for the B1G, and the rest of us up the creek, except whichever 2 schools the SEC will take. Like I said, it's time for NCSU to be proactive, not reactive. They'd certainly take VT, we just need to be lucky #16.

If FSU goes, the dominoes will start to fall. They'll take Clemson with them, B1G will move on UNC once UVA is a done deal. At that point we need to align ourselves with VT so that the SEC would be inclined to take us as a package deal. Miami might bolt also (though to where, I'm not really sure) and the ACC would be left as a good basketball conference with a bunch of football also-rans. (Duke, Syracuse, Pitt, presumably UConn, Wake if they get their shit back in order, etc.)

Though UNC only playing Duke 1x per year, and NCSU not at all some years, would be really bad for basketball as a whole. Tearing apart rivalries like these is the price of football's dominance.

So basically I hope the ACC wins this showdown and FSU stays put. We can easily survive minus UVA if they decide to go. That could lead to ND joining as a football member down the road and the conference's 2-sport relevance would be assured.

Would they try to prevent it from happening? UNC/Duke isn't what it used to be. Having them play only once a year would give ESPN a better chance to run up their hype machine as a "once a year event!"

ND just got vindicated and there TV contract is up. That mean NBC will throw $Texas at them. they have a BCS tie-in in the new system and can still make it to the NC game in the new system. I think they even get money if they don't make a bowl or BCS bowl (1 mil, i heard that somewhere could be wrong).

ND will never join in football. they only thing adding ND did was let the big 10 know that ND will never join the BIG10 and so they added Rutgers and MD.

acc should just bite the bullet and try to pick off a big 12 team despite the contract language regarding revenue. if this is going to be an acc vs. big 12 struggle for survival, acc might as well throw in for a tcu and kansas and beat them to the punch

What if we went to the Big East?

We'd still be in a competitive basketball conference (Georgetown, Nova, UConn, Marquette, potentially add Xavier) and have football competition better suited to us, plus the natural rivalry with ECU.

I don't care about football greatness. It isn't coming.

If anyone goes, I would imagine it would be UNC/UVa to the B1G or FSU/Clemson somewhere... and those are highly unlikely.

Kind of funny that a safety school like Louisville got the bid in large part because UConn is a safety school for the ACC (i.e. - will always be there whenever they want them).

** Didn't realize how small some of the athletic budgets in the ACC are. Clemson, Ga Tech and Maryland were all $20M+ less than Louisville and all even less than UConn.
