Regardless of the original offense, if you resist arrest, then there are consequences. He wasn't choked to death for selling cigarettes. You keep saying that shit because people will believe it.

I do however think the cop should have been charged with at least manslaughter here. There was no reason to use the kind of force that he did.

So you are really in here defending that cop? That cop had multiple complaints against him for civil rights violations. He was trained to never put a person in a headlock to avoid this exact issue. He chokes a man to death, and then arrest the person filming it. And you defend him. Fucking disgusting.

he had his arms up while somebody choked him from behind. in what world is that considered resisting arrest?

and while on the ground, he continued to yell, "I can't breathe".

you still wanna consider that resisting?

The type of chokehold the officer used was outlawed by the NYPD in 1993, for anyone who gives a shit.

He kinda flails his arms and doesn't surrender himself to the cops. But he's not agressive at all.

I guess by definition that is "resisting arrest". But he is far from agressive and doesn't seem to be posing a legitimate threat to the officers.

what charge were they asking to indict? since choke holds aren't allowed, could they try again for an indictment for assault?

I'm guessing they went for murder, since the NY medical examiner declared the death a homicide.

Maybe it's one of those all or nothing deals and they can't go back and charge again? I don't know, I'm not a lawyer. I dint know how that works.

they could have charged him with anything. they didn't "go for" anything.

the grand jury had the option to indict thiis officer from anything ranging from involuntary manslaughter to 2nd degree murder.

Minor sticking point....


The medical examiner would be determining the cause of death. His choices are:

Natural
Homocide
Suicide
Accident
Undetermined
Fetal (if you want to get picky)



So, them saying it was a homocide isn't particularly remarkable. That is just them saying a person was killed my another person. They aren't determining whether it was a justified homocide or not.

I want to know how a grand jury can watch that video, know that cops back story, know that choke holds are illegal, and come back with no charge.

^Homicide is homicide. That grand jury essentially has said that this mans death was justifiable homicide. I hope I'm never in a choke hold begging for my life while a cop kills me. Next to drowning, getting choked to death is probably the worst way to die.

I think that you misread what I posted.


To the MEDICAL EXAMINER homocide is homicide. They are just saying a person killed another person...instead of a person killing himself, or was killed by accident, etc.
the medical examiner is NOT saying whether it was a justified homocide or not.


Now, here the STATE, grand jury, etc... is saying that it is not going to be investigated as a crime.

up until a month ago, for those with that line of thinking, he was "one of the good ones". now that he's been outed as a rapist, they have assigned that role to Charles Barkley.

Also there's a large amount of intersection between those groups and the group that routinely votes against their own self interests.

One thing these police killings show, is there's a lot of blind faith idiots running around in this country.

I thought cameras on police officers would help stop situations like Brown but now I don't even think thats enough considering there was a video of the entire incident and it still didn't go to trial. What do we need to do to have police be accountable for their actions?

There better be some pretty damning evidence that isn't on that video to justify this mans death. Probably had copious amounts of marijuana in his system, in tandem with his demonic eyes. Eventually someone will take the law into their own hands. I know damn well if that's my family member this cop choked to death, and the justice system failed me...he'd have hell to pay.


Also since American citizens are somehow too stupid/incapable of making the correct decision in a case as cut and dry as this one, lets go ahead and look into fixing the grand jury system.

I'm not defending the cop here. I think it is pretty obvious the cop was in the wrong here. Alls I'm saying is kids...don't resist arrest and you won't get murdered by cops.

yeah... "resisting arrest" rings a bit hollow when you are being choked to death. Sorry, but I think it's reasonable for a person being choked to death to fight back.

Don't know what that guy was thinking. The choke hold is not taught in any self defense class taught to any law enforcement officer as a use of force method that is acceptable to detain someone resisting arrest. This cop deserves to be fired/charged. Absolutely mindless and idiotic.
