not defending the cop, but what is a cop supposed to do when someone resists arrest like that?
12/3/2014 7:57:08 PM
It is a near-reflex for the body to resist life being literally squeezed out of it.
12/3/2014 7:59:10 PM
i'm talking about someone who won't put their hands behind their back for handcuffs. i'm not sure what they can do besides take them to the ground.
12/3/2014 8:03:34 PM
Take them to the ground without strangling them?I'm not sure why this is being framed as a 0/100 issue.[Edited on December 3, 2014 at 8:10 PM. Reason : we're going to need James Brown to save the city from riots]

let him go and fine him later. god forbid he sells another cigarette.
12/3/2014 8:13:03 PM
So you are really in here defending that cop? That cop had multiple complaints against him for civil rights violations. He was trained to never put a person in a headlock to avoid this exact issue. He chokes a man to death, and then arrest the person filming it. And you defend him. Fucking disgusting.
12/3/2014 8:15:27 PM
12/3/2014 8:17:37 PM
^ In the world where literally every action is justified when you have a badge. The type of chokehold the officer used was outlawed by the NYPD in 1993, for anyone who gives a shit.
12/3/2014 8:20:59 PM
He kinda flails his arms and doesn't surrender himself to the cops. But he's not agressive at all. I guess by definition that is "resisting arrest". But he is far from agressive and doesn't seem to be posing a legitimate threat to the officers.
12/3/2014 8:22:25 PM
based on the evidence presented by the media, it certainly appears that the officer should've been indicted
12/3/2014 8:22:59 PM
of course if there was no video, he would have been reaching for the cops gun.
12/3/2014 8:23:13 PM
what charge were they asking to indict? since choke holds aren't allowed, could they try again for an indictment for assault?
12/3/2014 8:35:09 PM
I'm guessing they went for murder, since the NY medical examiner declared the death a homicide.Maybe it's one of those all or nothing deals and they can't go back and charge again? I don't know, I'm not a lawyer. I dint know how that works.
12/3/2014 8:39:12 PM
they could have charged him with anything. they didn't "go for" anything. the grand jury had the option to indict thiis officer from anything ranging from involuntary manslaughter to 2nd degree murder.
12/3/2014 8:41:36 PM
listening to the news, it sounds like any charge would have been on the table.
12/3/2014 8:45:37 PM
Minor sticking point....The medical examiner would be determining the cause of death. His choices are:NaturalHomocideSuicideAccidentUndeterminedFetal (if you want to get picky)So, them saying it was a homocide isn't particularly remarkable. That is just them saying a person was killed my another person. They aren't determining whether it was a justified homocide or not.
12/3/2014 8:48:47 PM
I want to know how a grand jury can watch that video, know that cops back story, know that choke holds are illegal, and come back with no charge.
12/3/2014 8:50:22 PM
I think that you misread what I posted. To the MEDICAL EXAMINER homocide is homicide. They are just saying a person killed another person...instead of a person killing himself, or was killed by accident, etc. the medical examiner is NOT saying whether it was a justified homocide or not. Now, here the STATE, grand jury, etc... is saying that it is not going to be investigated as a crime.[Edited on December 3, 2014 at 9:00 PM. Is it just me, or is there a large amount of intersection between people who think Cosby had never molested anyone, and that cops are justified in targeting blacks?

I thought cameras on police officers would help stop situations like Brown but now I don't even think thats enough considering there was a video of the entire incident and it still didn't go to trial. What do we need to do to have police be accountable for their actions? [Edited on December 3, 2014 at 10:24 PM. Reason : a]

There better be some pretty damning evidence that isn't on that video to justify this mans death. Probably had copious amounts of marijuana in his system, in tandem with his demonic eyes. Eventually someone will take the law into their own hands. I know damn well if that's my family member this cop choked to death, and the justice system failed me...he'd have hell to pay. Also since American citizens are somehow too stupid/incapable of making the correct decision in a case as cut and dry as this one, lets go ahead and look into fixing the grand jury system.[Edited on December 3, 2014 at 10:56 PM. I wonder if you can defend someone being killed by cops like you can when cops aren't involved. Like a third party defense. But also, why didn't they just tase him?
12/3/2014 11:33:05 PM
I'm not defending the cop here. I think it is pretty obvious the cop was in the wrong here. Alls I'm saying is kids...don't resist arrest and you won't get murdered by cops.
12/3/2014 11:43:52 PM
that's whats known as "victim blaming" a common example of victim blaming is, "don't wear a short skirt and you won't get raped"
12/3/2014 11:49:53 PM
yeah... "resisting arrest" rings a bit hollow when you are being choked to death. Sorry, but I think it's reasonable for a person being choked to death to fight back.

^^^I mean, the same could be said about those Americans, who don't trust the government yet reflexively trust and defend every action of the military. The state can't do anything right.....unless it's killing the defenseless.
12/4/2014 2:32:01 AM
Don't know what that guy was thinking. The choke hold is not taught in any self defense class taught to any law enforcement officer as a use of force method that is acceptable to detain someone resisting arrest. This cop deserves to be fired/charged. Absolutely mindless and idiotic.
12/4/2014 5:50:30 AM
