^4yes. if a person can be so drunk that they their consent can be invalid, that suggests that there is a point at which a person is too intoxicated to be responsible for their actions. If that is true, then logically someone can be so intoxicated that they shouldn't be held accountable for rape. Taking it to an admitted, but ever so slight, extreme. If someone can be held mentally incompetent through insanity and other such categories, then drunkenness isn't so different.

how are they different? in both situations a person has to understand what they are doing. again, we acquit or lessen the sentence of people who are considered not mentally competent, which consists of reasons from retardation to insanity. If that is the case, then we have to accept that a mental state that is altered from the norm, which drunkenness is, alleviates a person from their actions to some degree and that they should be served reduced consequences.

I don't disagree with that. Getting drunk is a choice for both parties involved in intercourse. If someone chose to get drunk, but is chosen not to be accountable for their action of consent, then anyone else who chose to get drunk and participate in that same act of intercourse must also not be accountable for their actions.
