Apparently the cashier with the rod was an ex convict for killing someone when he was like 17.srsly, not the kind of person you should mess with. But he didn't do anything until someone else got aggressive. Doesn't really make mcdonalds feel less safe, just don't start nothing.

It would be interesting to see how this is argued in court. Other people were obviously, at some point, trying to get him to restrain himself, but we also don't see what's happening behind the counter. It's possible that they were moving, trying to get up, and appeared threatening in some way. It would not be an easy defense, but I imagine it will be argued.Plus, in a jury trial, there's no telling. There never is. They could see him as a hero just like the public and much of the media has. It only takes one.

I don't think you can concealed carry in NYC.If the same thing happened in NC you would be charged with manslaughter. If Person A (the two girls) instigates the fight and Person B escalates it (the guy with the rod) you will be charged with manslaughter if you shoot Person B to stop him from doing further injury or killing Person A.[Edited on October 19, 2011 at 12:53 PM. First off you can't fire a warning shot (if you take out your gun other than to shoot someone, you will be charged). You might also be charged for intervening, but it is something that you will more than likely be exonerated on- there will be a lot of legal tape but a competent lawyer could make a great defense.

^^ even pulling out your gun and saying you could shoot can be considered threatening. The way the law goes you can only take out your gun to use it. Granted if it went in front of a jury, it would more than likely be dropped, but as it is now, it would be considered brandishing a weapon

If you pull a firearm you had better be ready to use it to end a life and you have significantly escalated the situation. no, you cannot fire a warning shot, blank or not. you'd be charged with discharge of a firearm within city limits (or whatever they call it) at the minimum. the only exception is in the course of self defense (and that depends on city/state law; no city in nc prohibits discharging a firearm for self defense).as for this particular case, as a third party, you could very likely be charged for coming to the defense of this man. i sure as heck wouldn't pull my firearm to defend him. the laws surrounding this are open to interpretation and a bit mucky. safest thing to do is never defend a 3rd party... unless:- it is family- you know ALL of the details leading up to the situation (highly unlikely)- you reasonably believe the attacker is intent on death or serious bodily injury- deadly force is the only force capable of stopping the threat.let's say you have a son, who earlier in the day was experiencing road rage and flipped off/cursed at another driver, etc. then you and your son meet at mcdonald's, a few minutes after the incident. while you're in the bathroom, the victim of the road rage comes in, you walk out of the bathroom, see the person start attacking your son, you pull your weapon and fire at the person.it's your family and all you saw was some stranger come up to your son and start beating him. theoretically, you could be charged since you fired upon the original victim and your son was the instigator (legally, you cannot defend the instigator).[Edited on October 19, 2011 at 8:44 PM.
