when are you required to show ID? obviously if you are driving a car, but if you are just walking down the street don't you have a right to remain silent and not show ID?


in other words, Is there a law saying you have to have an ID on you if you are not driving a car?

I had a buddy, years ago, who got busted for selling pot at school. Now according to my buddy, the police never read him his rights. But when his lawyer brought this up in court/grand jury, all the cops swore that they HAD read him his rights, and of course the judge/jury took the police's word over his. So he got whatever punishment he got.

Assuming my friend was telling the truth, is this sort of minor perjury common among policemen?

I know a guy that got out of a DWI because the cop told the truth on the stand. The cop admitted he did not read him his rights and questioned him after he was handcuffed. There was multiple officers at the scene or something and they either forgot or thought the other one done it.

Certainly there are plenty of cops that lie in court when they know they wont be caught, but there are plenty of honest ones too.

Is it really legal for women to go topless in NC? I heard this from someone that sunbathes topless at the beach and from what I found online it seems legit. The indecent exposure statute forbids the exposure of one's "private parts" which the courts have deemed to include "sexual and excretory organs" but not a woman's breasts. There was a bill introduced not too long ago that would amend the statute to include "the nipple and any part of the areola" of the female breast, which has thus far languished.

Is this for real, or would you cite a topless woman anyway (if not for indecent exposure, then something else)?

Inquiring minds want to know. If feel like if this was for real it would be a lot more common than it is.

I think technically it's still legal. Don't know if they ever passed a statewide change to the law. There are certain local laws (like at public beaches) that prohibit going topless though.

A review of local ordinances for Brunswick county beach front cities/townships I find prohibitions in all of them (Caswell, Oak Island, Ocean Isle, Sunset Beach, Holden) except for Bald Head Island. Also checked Wilmington, also prohibited.

So I guess those that do it are actually breaking the law. I've always thought it was strange that female toplessness is considered more offensive than male toplessness.

The republicans wanted to make it a felony to show a b00b but for some reason never passed the law. It is a misdemeanor in most jurisdictions under city/county ordinances.

Asheville allows b00b showing, I think that's why the republicans wanted to pass the felony law so they could arrest all the hippies that usually vote democratic.

Ehh, 911 hang up is a stretch and starting to push the line because people might feel obligated to let an officer in. But, I've heard of officers getting invited into the home to talk about a community service project and then one thing lead to another and a consent search was granted.

When I drove a marked car, it wasn't uncommon. But if I was in the hood, it never happend.

^^ They are illegal, similar to the plate frames (which cannot cover the sticker or state name), a tinted cover over the registration place is considered concealing it.

Yes, either:

Plate frame violation of concealing the stickers and/or state name.

Tinted/mirrored/blurry whatever cover that covers the registration plate is also a violation.


Don't forget your registration plate cover lamp either.


More specific answer to your question, the plate frame violation is an infraction, the concealment is a misdemeanor crime.

I didn't read all 29 pages of this post, just the first and last, but it seemed that a lot of people were hating on GOD for hating on the cops.

I feel like he made a lot of valid points and that this comment kind of validates.

I don't think you understand the meaning of a pretexutal stop. Let's go through this step by step. Let's say, you (pretend you're a law enforcing, murderer seeking, super detective) have video evidence, some linking evidence, whatever else. you're building a case against a murder suspect for killing a store clerk in a robbery. You've identified the vehicle they used or something of the matter and are conducting surveillance. You see your suspect get in the car and drive away. Maybe you call for a patrol officer to come try to stop the car to identify your homicide suspect, but don't want to tell them you're stopping them because you know they have killed someone.

A patrol officer follows bad guy who then throws a cigarette out the window. Patrol officer stops bad guy for LITTERING, with the intentions of following up, obtaining information, gathering evidence, etc of something NOT LITTERING.

Two things, they would never do this with a homicide suspect, at least not in my department and two, this works for other crimes as well.

But, moral of that example, it's not a violation of your constitutional rights to conduct a traffic stop/detainment/investigation stop if you have stopped them for a violation to begin with, even if it's a pretextual stop.


Don't forget, law enforcement officers are people just like you... We can walk about public places and even come up to you and talk to you and have a VOLUNTARY encounter. We are not barred from talking to you without reasonable suspicion or probable cause... Our presence alone and walking up to you and having a conversation with you is not a detainment unless it's a detainment... If you're unsure, ask, and ask if you're free to leave.
