^^Problematically, pharmacists have even more ... discretion. They can refuse to fill a prescription if it violates their own moral code. Now, I'm in favor of private businesses being allowed to refuse service, but you would think that if you work for say, CVS, you would pretty much be required to fill a valid birth control prescription.. not the case.

Also, this dude chick sounds like a nut and should probably have his medical license reviewed and possibly revoked.

the thing about pharmacists, though, is that the people who have the objection to filling BC prescriptions are a dying breed, so the problem solves itself. just go to another pharmacy or raise hell with the manager

With the DOMA challenge Supreme Court case coming up on the 26th & 27th, there seem to be events spawning around NC on and before those dates. The case could affect whether or not amendment 1 remains valid.

i am ok with gay marriage but i dont see how the supreme court can say laws can't be based on morality alone. if that was the case then thousands of laws would become unconstitutional such as gambling and prostitution just to name a couple

if one did, it would have to be a state court not a federal one as this power is not given to the fed in the constitution. yes i know that hasn't stopped them before. Also no way they would take away that much power from themselves.

I think the argument goes that any law that discriminates against a class of people must be examined "heightened scrutiny" to justify that discrimination.

Prostitution doesnt just fall under "hey I can do whatever I want, victimless crime, just having fun, etc."

The state has a vested interest because of public health risks.

Gambling has demonstrable ties to organized crime, huge amounts of money, and addiction, etc.

Both probably have tax issues (or lack thereof) that the government is interested as well. You arent going to get out of them regulating both harshly. I seriously think you should all continue sticking it to the man, however.

I mean I think you have a point if you are trying to say that the Supreme Court has gained power over the last decade or two, but the 10th Amendment does not restrict the Supreme Court from hearing cases on state statutes. The Supreme Court can hear any case that involves constitutionality.
