I said it's the worst case. All I'm trying to say is you are not allowed to be paid less than minimum wage otherwise someone is breaking the law.

Went to Champs today, the waiter was completely incompetent. He came out and asked for our food and drink order twice b/c he forgot it. And it seemed like he was also drunk or high. Horrible service.

I did not give him a tip. Normally I'm a 20% tipper.

Yeah, but your argument is totally wrong.

There are lots of times when servers have a shitty shift and walk out after an 8+hr shift making like $50. It fucking sucks to run your ass off all day and have people stiff you left and right. Whatever you didn't make that day in tips, you'd better hope that the next shift makes up for some of it!

At least retail employees can get overtime for staying late. And their hourly wage never fluctuates.

YOU'RE the one being obtuse and refusing to understand what the reality of the situation is, not me.

I can deal with tipping waiters and pizza boys since I can do it on my credit card pretty easily.

What I can't stand is tipping every asshole I come in contact with at a nice hotel. Before the trip I have to make sure to take a bunch of $1s and $5s like I'm going to a strip club, which is a pain in the ass

^^so your argument is that you think the math should be done over a period of a shift instead of over a pay period?

seriously? that's it?

I get exactly what you are saying. If you get a paycheck at the end of your 2 weeks it plus your tips must come out above minimum wage/hour. If it doesn't you are obligated to be paid the difference, period. If it averages out you're fine.

Ultimately I'm gonna drop it here because we both are gonna argue we're right. I just don't like this bullshit moral imperative argument that gets raised. I just want someone to admit that they like taking bribes because it is good for them most of the time and they want to keep it that way. And it is a bribe even though it occurs after the fact because it impacts what you or someone who looks (black people) or acts like you gets for what should be an equal service.

Who enforces the thing where the employer is supposed to make up the difference if the tips don't add up to minimum wage?

It sounds like to actually get the extra money when the tips are not adequate the employee would have to ask for it (kind of shitty...no one else has to ask for their paycheck) or complain on their employer to some government agency, neither of which are good options when you are at risk of getting singled out for firing, bad shifts, scrubbing the shitters, etc....

It's not enforced, because nobody does it.

Like I said, it's per pay period, so it's not like you can go up to your boss and be like, hey I had a bad shift, can I be compensated and make minimum wage for the day so I'm not walking with like $30? If that were the case, people would probably do it all the time. I mean I would...

I wish the waiters were paid at least minimum wage and the tips were split between the waiter and the kitchen staff. I have a lot more problems with fucked up food or food taking too long in restaurants than bad service. When the kitchen is fucking up I don't stiff my server, but I bet a lot of folks do.

So if you're a stripper and you are checking your mailbox, watch out, because once every two weeks ADP is gonna make it rain paystubs up in there.

pretty sweet news right here

Quote :
"Are These The Final Days Of Automatic 18% Tips At Restaurants?"

Quote :
"Many restaurants have a policy of automatically adding a 15-20% tip for large groups of diners, but that practice may be going the way of the dinosaur as a new revision to IRS income tax rules will make such auto-gratuities less attractive to servers and management.
The change, which goes into effect in January, reclassifies automatic gratuities as service charges rather than standard tips. To the consumer, this doesn’t mean anything, but to the restaurant and the wait staff, it could be a big headache.
Currently, when the restaurant adds $45 to your group’s $250 bill, that amount is still considered a tip. The servers get all of that money and are responsible for paying tax on it themselves.
But when that gratuity suddenly gets reclassified as a “service charge,” the money is now treated like regular wages, which means the restaurant owner has to withhold payroll tax.
For the server, it means they initially receive less money in their pockets and don’t have as much wiggle room when it comes time to file their taxes (because, let’s admit it, not every restaurant server is reporting every dollar received in tips). This is especially true for servers who work at eateries popular with after-work crowds that often handle big groups.
Restaurant management, meanwhile, must now deal with an added headache of sorting out service charge money from tip money and knowing which to withhold taxes from. As things are now, the restaurant pays a base wage (usually below the federal minimum wage level) and lets the servers keep whatever tips they receive. But after the new rule goes into effect, that automatic tip money has to be figured as part of a server’s hourly wages.
For example. Waiter Steve makes $3.00/hour plus tips. For a 40-hour week, that’s $120 plus tips. So long as his tips bring him up to the minimum wage level, the restaurant doesn’t need to pay him anything else and only figures payroll tax based on the hourly wage.
Right now, Steve averages three large tables a week where the automatic gratuity averages $70/table. That $210 goes into his pocket and he pays taxes to the IRS and state himself.
After the new rule kicks in, that $210 is no longer considered a tip but is now deemed to be part of Steve’s wages, more than doubling the base pay the restaurant had been figuring previously. And what happens when there’s a dry spell and those big tables dwindle down to only one per week? Now the restaurant is figuring yet another hourly wage for Steve.
Darden Restaurants, better known as the parent company of Olive Garden, Red Lobster, LongHorn Steakhouse, normally adds an 18% automatic gratuity for parties of 8 or more, but recently dropped that policy at restaurants in four cities in advance of the IRS rule change, and to test a new system that calculates and suggests tip amounts of 15%, 18%, and 20% for groups of all sizes.
Likewise, the folks at Texas Roadhouse are getting rid of their 15% auto-tip for parties of 8 or more.
“I don’t want my tips to be on my paycheck as a wage. I like to get my tips at the end of my shift because I know what I’m getting right away,” one server at the restaurant chain tells the Wall Street Journal.
The IRS updated the rule because it maintains that a mandatory gratuity is not actually a tip if it’s not voluntary.
“I think the vast majority of restaurant owners will discontinue the practice,” an employment attorney specializing in the restaurant business explains to the Journal.
A small number of upscale restaurants have recently switched from tips to adding mandatory service charges to all bills, while even fewer eateries have done away with tipping and service charges altogether and simply built the extra costs into the prices on the menu.
Earlier this week, NY Times restaurant critic Pete Wells wrote that it’s time to do away with the institution of tipping, which he dubbed “irrational, outdated, ineffective, confusing, prone to abuse and sometimes discriminatory.”"

Drop tips and raise wages/food prices? Then you are going to get a McDonald's equivalent of service EVERY TIME you go out to eat...

Plus, no way a bartender stays at a job they used to make $25+/hr at to sling drinks for a set wage close to minimum.

Bartending money bought my first house and paid for my law school loans. Kept me afloat while I started my own practice. Probably was at least half of the funds used to start my first restaurant.

Thank god I didn't work for a regular wage.

Imagine your life if people weren't guilt tripped into giving you more money than you deserve. I have a friend that works as a waiter, he brags how on any night he can walk out with 200+ for 6 hours of work.

Also you stole tips from real table waiters.

I hate the damn buffet places that expect a full tip for topping off your drink

I would be more than happy to refill my own drink when I get another plate if it would eliminate this stupid expectation

Do they though? How do they communicate these tip expectations to you?

So yesterday was my brother's last day at his waiting job....he quit to take a different job

He texted my mom and me a photo of a bill that was $198 with a $5 bill beside it. Damn. He said they were all excited for him about his next job (I guess they talked a lot to even know that) and they hugged him and said good luck on your new job on their way out.

We were hoping so hard that it wasn't a black family.....it was .

Felt so bad for him.
