I see a "pasties only" parade coming up somewhere in the Triangle are in the near future. The whole thing about public display of female nipples being indecent while male nipples are perfectly fine is the reflection of the puritan-derived culture we live in. Totally makes GOP looks hypocritical, lashing out against government regulation on issues that have real impact on society, and then regulating something statewide that should be decided on local, if not personal, level. 5 month minimum sentence for a nip slip? I dont understand why people don't realize that these moral value attacks are fascisits principles. There is actually a good bit in common between republicans and fascists that people don't seem to consider because you can't say fascists without bringing up Hitler. But, in terms of the principles behind fascism, there are a lot of similarities.

You're conflating the two independent sections, they are two different "crimes." If charged and found guilty of violating Section (a) you will be sentenced according to Class 2 misdemeanor guidelines. If charged and found guilty of violating Section (a1) you will be sentenced according to Class H felony guidelines. This is not a new law, this is only a revision of the current "Indecent Exposure" statute - the revision being the addition of "nipples" as a sexual organ. No legislator has gone on record or otherwise and declared the intent of this revision is to make felons of those attending topless rallies.

Section (a1) cannot be used against anyone simply participating in a topless rally. Section (a1) covers activities above and beyond a topless rally or drunk guy who takes his pants off and walks down the street. Note the statutory cross-reference to 14-202.1 in section (a1).Again, this is not about defending the underlying revision to the bill, but about clarifying the misunderstandings being perpetuated about said bill.
