I worked for a small company that denied EVERY unemployment claim, regardless of fault. I guess her thought was that if she dragged it out long enough then the employee would probably find another job and never actually get the claim. She even denied a lady that left on medical leave (she had cancer) and when she came back her job had been filled.She denied me and my girlfriend's unemployment, and it took nearly 6 months of hearings with the ESC before we got it. Had we not gotten a lawyer from Legal Aid, we would have been screwed.

Is there any way that you can get them to make it look like you quit or got RIF'ed rather than fired? If you've truly got a case and not even a winnable one but one that might cost them money in legal fees they might let you "quit" so you'll find a job quicker. Otherwise I'd just move on, then again I'm always paranoid that anything I do will keep me out of a better job. Best of luck with this anyway.

I was "let go" from my previous job (in NY) for dubious reasons. My company decided to "eliminate" my position when I was out on short term medical leave. I had been out of work for 3-4 weeks so I could recover from ACL reconstructive surgery. This was all something that I had planned out months in advance so there was no major inconvenience to my company.On my very first day back in the office I was called into a manager's office and let go at 9:30am. My direct superior wasn't even at work that day, he was out on vacation. The whole thing seemed like 100% complete bullshit and shady as hell. But I was looking to move back to NC anyway so this (kind of) made it easier.So I said fuck it and didn't do anything about it.Sorry you lost your job, but it sounds like your best course of action is to move on (assuming that you can collect unemployment).

After reading simply the background facts, I'm so thankful I work in the Military. We have to comply with all (or most) of the regulations mentioned here, but we'd never fire anyone over a violation where no one got hurt. When I worked in QA we had an upper level aircraft maintainer accidentally turn [start] an engine with a guy working under it and the Maintenance Officer just pulled his CDI qual. If you people are getting fired for [repeatedly] standing on chairs, I'm staying in the Navy.

I was in a similar position from a previous job. They built up a mountain of paperwork against me because they wanted me gone. Wrongful termination may apply here, but even if you win on that particular point, they'll find another reason to see you stay gone. And unfortunately in these cases, the power of information is on their side. Good luck getting access to records, emails, coworker statements at this point to prove your case.Unemployment in NC pays up to $535 a week. Not as good as a paycheck, but better than nothing. With unemployment, make _SURE_ you fill out whatever paperwork they require of you. They will deny unemployment if you do not fill out your paperwork properly (or on time). EDIT: Go to HR of your company and request a copy of your records if you do plan to file for unemployment. This is reasonable and they should be able to accommodate. (It will also help your case if you need to appeal for any reason).In retrospect, I'm doing a LOT better now than I was at that previous job. In reality, you should have filed the day you got let go.And yes, you get paid every Monday IF you file your weekly certification (also online) every Sunday. I set a reminder in my phone so I don't forget, and with direct deposit the money is there every Monday like clockwork.

So to add insult to injury my determination for unemployment came back that I was denied benefits due to gross misconduct for "unsatisfactory job performance and attendance. Claimant failed to follow safety procedures and report for daily meetings." I never got a response from HR regarding the 3 page letter I wrote 3 weeks ago disputing my alleged safety violation. Now they are heaping on additional "cause" for termination....What has been anyone's experience with disputing an unemployment claim. I already talked to two former co-workers. One still works there and one quit (because of my asshole manager) who both said they would vouch for my work performance and my relationship with my supervisor.Ultimately it sounds like this is my word versus HR's word, where HR's information is solely based on the subjective opinion of Julio Mendoza my former boss. I had a detailed list of e-mails highlighting my boss's ill mannered behavior through e-mails but of course this was stored on my work computer.By the way the only thing i can think of for attendance related was when I was written up for sending out a notice the night before that i was not feeling well and was going to the doctor first thing in the morning. Secondly when i first started I was assigned to work with an installation team. At the time I still had a house in Wilmington and a girlfriend there. The install team usually drove up Monday morning getting in around 11am worked late hours M-Th and left early 2-3 pm on Friday. Since we usually worked late most of the time we didn't come in until 8:30-9 AM the rest of the week. I specifically asked my boss if i could work the project team hours since i was assigned to assist them and had a separate project boss for the first several months I was there. He gave me a verbal affirmation and never brought up the issue. Everything was fine until 4 months later during the summer on a Friday in which one of the engineers was on vacation and one was our after having worked all night for on-call duty. At this time there was 3 electrical engineers including me under Julio. Some major piece of equipment broke, requiring electrical engineering support at like 4 pm. Julio went looking for me as I'd fill in as production support took priority over install work. Only to find out I had left. Apparently he got in trouble for not having engineering coverage and from what I heard from another manager basically threw me under the bus saying I left early without permission He then printed out my clock-in and wrote me up for not following an 8-5 schedule. I balked, reminding him that he said i could follow the install teams hours. He claims never have said such thing and as the install of new equipment was almost over, just said screw it and proceeded just to work 8-5. Given that his office is two cubes down from mine there is NO FUCKING WAY, he "didn't realize" I was not working the traditional 8-5 prior to this incident.The funny thing was at the time I was probably working more hours then anyone else in his group, not counting the person on off-hours duty. Just out of curiosity is the uptick in UI tax that much were a company as large as Corning will actually bite their teeth into to persist that my firing was rightful for misconduct???You'd think the cost of paying HR resources and an attorney to fight my appeal wouldn't be worth the hassle.I'm not saying you are wrong djeternal it just seems that if a company's ability to deny a claim was that easy then you'd imagine every company would just fire everyone for "misconduct" in order to keep their UI low. ^ probably yes. if they let you slide, then they will have to let everyone slide. So multiply that UI uptick by every employee they fire. UI is kind of an all or nothing type of deal, ESPECIALLY with large companies. Some companies are so large that they just budget for it and don't ever deny UI. Apparently Corning isn't one of them. The fact that they even denied it in the first place shows that they are ready to fight.Seriously man, speaking as someone that has been through it, your time will be better spent looking for another job. One that i went to my boss after the tech accused me of being unsafe, showing him the applicable rule, yet they still fired me. They would then try to pile on a bunch of crap when i filed for UI claiming that I was fired for attendance, lack of performance, and numerous safety violations .If I was such a shitty employee then you'd think my two previous managers would not be writing my recommendations for graduate school and agreeing to vouch for me for future job positions.Funny coincidence that this also correlates to a bad fiscal year in which they are in the middle of laying off all contract salaried personnel and 25% of the salaried workforce .[Edited on December 26, 2012 at 11:59 PM. Yeah, I was a sales rep for a small privately owned staffing agency (8 employees including the owner) when I was let go. It was right at the time when the economy turned south. Companies were letting people go to cut costs, and most definitely NOT using staffing agencies for hiring. So needless to say, sales were few and far between. I became "involved" with the other sales rep who is a female. (sidenote, we have been together for over 4 years now) My boss found out about it and fired both of us, along with a 3rd person that had nothing to do with our relationship. The reason for termination on all 3 of us was "Using the company computers for personal use". My GF and I were sending some pretty explicit IMs to each other during work hours, and the 3rd employee was checking her personal e-mail. I had just gotten a raise less than a month before I was let go, so it clearly wasn't based on performance.Real reason for termination: The poor economy and my boss being butthurt that 2 of her employees were fucking without her knowing. (which was perfectly within the company guidelines).How I won: Well the remaining employees were friends with me on Myspace. So for 2 weeks I tracked their usage and took screenshots every time they were on Myspace during business hours. I also had several e-mails from all of them, INCLUDING MY BOSS, sent to my personal e-mail account during business hours. My defense was that we were discriminated against using a policy that no one in the office adhered to. The tracking software that was used to "bust" us was only put on our 3 computers, which clearly showed that we were targeted.My GF and I won our appeals after about 3 months of fighting, the 3rd employee didn't. We had a lawyer, she didn't. In all honesty, we probably shouldn't have won. We were, after all, fired for cause as we broke a company policy. But the fact that we could prove it was a policy that everyone consistently broke helped.So it's not impossible for you to win your appeal, but in my case I had many factors in my favor.....and most importantly A LAWYER.
