Say that I am a cigar aficionado and want to open a bar for others that share in my affinity for cigars. I found a space next to another bar, leased it, bought all of my products, and started hiring employees. However, due to the delay in getting my humidor built and installed, I was unable to open my doors until July 2, 2009. By the letter of the new law, I would be given the awesome news of all the money that i spent being thrown away, as my space is not a freestanding space and is adjactent to a space where smoking is banned, despite not being connected. Is that fair and just?Now i understand that my example there just involved a lot of very specific scenarios that all must coincide in order for the example to work. However, I am aware that it is really hard to keep a place open AND have cigar sales meet the 25% of total sales required to be exempt. So even if we are talking about a place that has been open for years and is specifically designed as a cigar bar, the owners still have to provide proof of their sales numbers each month or be subject to the ban. And for what it's worth, hookah bars aren't even given the option of being exempt as the law specifically only provided an exemption for cigar bars.I am taking this new law as an opportunity to stop smoking, as bars are pretty much the only place that i currently smoke anyway. I still think that the law is stupid and fucks over otherwise honest and law abiding businesses that may have to start fudging numbers in order to not alienate a client base that is built off of the practice of smoking.Also, the private clubs thing is awesome. As it pretty much only provides an exemption for country clubs. Those Senators have to be able to go down and have a cigar with their friends before a round of golf, right?

i've gotta agree with xplosivo on this one, since i, too, hate freedomone of the main arguments for this ban when it got rolling was to keep from exposing non-smoking employees of bars and restaurants to second-hand smokebut what about bars and restaurants (like the one i work at) where all of the employees are either smokers or don't give a shit about smoking?
