"It may be better to live under robber barons than under omnipotent moral busybodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those who torment us for our own good will torment us without end, for they do so with the approval of their consciences." -- C. S. Lewis

^ not likely.....BMI is thrown off by men (or women) who tend to have a lot more lean mass for their size frame. This can be from a regular disciplined weigh lifting routine or just natural. Nonetheless a person with a lot of muscle will weigh more and appear to be "overweight" according to their BMI.The only thing the state could feasibly do is take body fat % measurements of employees. BMI is truly useless beyond just slapping a label onto the sedentary population.

^^ Did they seriously draft this legislation without taking into account those that body build and may have a higher muscle lean mass than the average or those that our taller 6'2" and above. For a given weight the BMI gets skewed as your start drifting height to far by the mean. Some experts think that in order to accurately scale with height the formula should be changed to weight/ (height^2.4)
