So there's no room for probing our intuitions of social and political justice and fairness? Because if that's the case, then we'd never have the form of government we have today.

This is why you need to make a distinction between theory and practice when discussing these issues -- in discussing theory you figure out what sorts of things we consider just and fair, things we'd like to enact flawlessly. In practice we figure out what's feasible -- but criticizing theories of justice by pointing to current practice is conceptually confused.
