It's not 100% his fault, but it sure as shit is partially his fault.


except in the eyes of their respective insurance companies (the Camaro and IMstoned420)...then it's 100% both of their faults.

rpd is not there to determine fault in an accident. you cant base it off whether or not they get a ticket.

hell, i clobbered a light pole in downtown greensboro at 7:00 one rainy morning and i was all by myself. it was definitely my fault and i fucking hit a pole. i technically had to be driving wrecklessly or violating some rule, or i would have never hit a pole. i dont even remember seeing any cops. and i got no ticket.

cops write up a report but the insurance people don't care about it

Just like if there's a chain reaction wreck(i.e. car in front of you hits another car, then you hit them) you can also be found at fault the person in front of you could sue your insurance.

If you hit someone from behind its always your fault in the eyes of all insurance companies (the only exception is if the person in front was driving drunk or if someone rams you from behind at a stop). What causes the person in front to slow down or stop has no barring on fault (the camaro in this case). Also, in many/most accidents tickets aren't given to the person at fault.

short of them pulling out in front of you on a busy highway, its your fault if you hit them from behind--and even then, that would be hard to prove

Aha, not true. In my most recent accident I hit someone from behind!













Of course, this was only because we were both stopped at a light and a drunk driver plowed into the back of me at 35 mph.

you get the idea...

you can't always count on perfect conditions. Both he and the Camaro driver fucked up.

I'm not saying I'm not completely faultless here. I understand the concept of "it's always your fault for running into the back of someone." What pisses me off is that it wouldn't have happened if the dick in the camaro hadn't been an idiot and I would still have a car. Honestly, who follows all safety precautions when you're on the beltline?

I rear-ended a pickup truck one time because I crested a hill in the rain and the truck was COMPLETELY STOPPED just over the crest of the hill. From the time I first saw him, it was physically impossible to stop.

then he fled the scene of the accident.

Still legally my fault (I just didn't have to pay to repair his truck--only my completely destroyed car).

bitches in raleigh can't drive in rain period. That's why I try to stay off the damn roads when it rains. There's probably a >50% chance of being involved in an accident.

I bet I drive more aggressively than anyone in this thread. I've damaged a whole bunch of cars and motorcycles (and completely destroyed one car and one motorcycle). When it's because I fucked up, though, I'll admit it and take the hit.

I told you the Camaro guy is the main dude at fault. By the time he came into my field of view he had already spun around 180 degrees. You can tell because the driver side of his car isn't damaged at all.

Also, the Lexus isn't damaged much at all as you can kind of tell from the shitty camera phone picture. I wasn't lying when I said if I had ABS I wouldn't have hit them. I could feel the car skidding because the brakes locked up.

You're right about the Firebird thing. I had just gotten into the wreck and it just got stuck in my mind that it was a Camaro.

you know the Lexus chick isnt gonna give 2 shits how much you think it will cost to repair the car, she will go to the first place, whatever they say, that is what it will cost....a small dent could cost 2k to get out, then if the paint is messed up(white car) they have to redo that.....it all adds up fast...

I realize that, guy. But look at that picture and tell me where you see $2k worth of damage. I know it's not a good picture, but you can tell where the bumper started to come off of on the left side and there was paint damage and that was pretty much the only thing that happened.. I didn't hit her going that fast.

it's hard to see much of anything in that picture

but you can run up a $2000 tab for good bodywork in NO TIME. i mean, i've seen a $4000 estimate for what I'm sure was less damage than was done to the Lexus (I ended up getting it fixed for $500 and not worrying about some light, inconspicuous scratches on the bumper, HID headlight lens, and wheel).

$2000 is pretty much nothing at a good body shop.

^^ It's hard to tell because there isn't a lot of damage. Yall are looking for something that isn't there. If you really look at it you can see the 2 or 3 places where there is minor damage.

If the Lexus had hit the Firebird, then that would put the Firebird at fault and make it arguable that it was physically impossible to stop in time even if I had been following at a safe distance.
