if i got ass fucked in jail when i was innocent and they proved that i am... i'd want my own fucking state.
8/29/2007 6:15:50 PM

we all knew he wasn't black when we read innocent and freed in the thread title./racism

It's cases like this for why people are against the death penalty.

The legal mechanism grinds rape-kits under as entrepeneurs of the shingle-hanging variety.... do their thing

If this guy was wrongfully locked up, I sure as hell think his freedom (from incarceration and having hell beat out of him by convicts that thought he was a child rapist) was worth more than a measly 20K a year.
8/30/2007 9:08:00 AM
How in the hell does this still happen? DNA has been heavily used for 13 years now. It is unbelievable how incompetent our justice system is. Why wasnt this test done 10 years ago?
8/30/2007 9:09:29 AM
why go through the trouble when you already have someone in custody and a 12 year olds testimony. We all know kids don't start lying until 13. Plus we have some of the finest law enforcement in the land in NC and they are never wrong.
8/30/2007 9:47:56 AM
^exactly
8/30/2007 10:10:27 AM
^^lol
8/30/2007 10:12:34 AM
i thought the article said something about them getting rid of the evidence and only by luck some random dead cop had saved that dress... i could be wrong, but don't feel like re-reading bc i'm late for work
8/30/2007 10:14:30 AM
yea thats what happened. shit happens, sometimes things happen. hopefully he is set for life. id sue for a great deal of money
8/30/2007 10:35:50 AM
The next story on this will be how the DNA matches someone that is either dead or already in prison.
8/30/2007 10:39:23 AM
OR her 'older' bf who had sex with her and she got caught so blamed it on someone else.
8/30/2007 10:42:04 AM
I didn't even know you could get 18 years for rape.
8/30/2007 10:46:02 AM
^yup, so you better re-think those weekend plans of getting laid.
8/30/2007 10:47:32 AM
either God "has a plan", or an incredibly fucked up sense of humor

yet another incident that proves eyewitness accounts are some of the most unreliable pieces of evidencethink about it, you don't remember someone like an exact photograph, there are so many other factors that come into play, human memory is in no way exact, especially when it comes to thisits not the girls fault, she told what she thought was trueits the damn jury's fault, although they should not have to pay, we as a public should have to pay and will pay when he seeks damages from the county/statejurys too often make decisions based on their gut "feeling" or the defendants personality - which should only hold weight when it works to the defendants innocence. More emphasis MUST be placed on the benefit of the doubt, and only physical evidence should take away from that doubt.how many wrongful convictions do you think occur at the misdemeanor level? speed trials consisting of an officers word (based on eyewitness accounts) against a defendant's word is all that is needed to convict.our justice system is fubar[Edited on August 30, 2007 at 11:03 AM. 18 yrs...
8/30/2007 11:08:54 AM
shit like this makes me hate our legal system, esp before there was so much science involved. the cops could have easily convinced the girl that this was the right guy. she's 12 and manipulatable (sp?) seriously the dude should have taken the guilty plea and probation but the fact that they offered him such a stupid sentence for rape (3 months probation?!?) only further proves they knew they had no case..and got lucky as shit. it blows my mind that our cops/prosecutors consider themselves to have done a better job if someone does more time, whether it's fair or not
8/30/2007 11:09:23 AM
^ 3 years not months,
8/30/2007 11:19:08 AM
oops, sorry haven't read the article since yesterday..still, my point is the same. i'm not sure i would have taken it either tho
8/30/2007 11:20:08 AM
I don't get this
8/30/2007 11:24:22 AM
Obviously she isn't the brightestand
8/30/2007 11:25:49 AM
Now this guy's being sued for child support for the 18 years he was imprisoned.

Dude wtf just leave the guy alone. btw did he have to pay taxes on that $360 000?
10/24/2007 12:49:09 PM
we live in a crooked-ass world. he shouldnt be liable for that. isnt it like monopoly where he doesnt have to pay his debts while in jail, but he cant earn money either?
10/24/2007 12:59:48 PM
they should make the lawyer who sent him to prison pay the back child supportoh snap!
10/24/2007 2:36:56 PM
If anything I believe that the mother of his son should be suing the state just like I believe Dail should be able to do (for more money than he is already receiving). The state robbed the mother of her life as well but not on nearly the same level as they did with Dail himself.I found it interesting to note the reporter's observation of the childlike behavior of Dail after being released from Prison. Surely this man is more grown up and mature than the vast majority of his peers.
10/24/2007 4:06:06 PM
so people in the McD's case can win millions and someone like Dail gets 360,000 for basically having his life ruined. sad [Edited on October 24, 2007 at 4:44 PM. Reason : ]
10/24/2007 4:44:24 PM
I'm going to sue the state on grounds that I never got a chance to meet this dude and have a few beers with him. Oh yeah, and I'm going to sue him too while I'm at it. I might just sue his momma for good measure while I'm at it.Anybody else want to get sued?
10/24/2007 4:50:47 PM
