i think he meant theft in a figurative sense, in that you are taking/using/destroying something that belongs to someone else without their consent and/or by force.other than drugs, that definition fits the rest of the crimes on your list.

i think it borderlines cruel/unusual, more unusual than anythingand the fact that they were given a choice between it and jail is not an excusea ruling in which two men were allowed to either a) go to jail for a certain num of years or b) get castrated was overturned, rightfully so, but just to show that a choice is not an excuse if one of them is cruel and unusual - not that rape convicts don't deserve it, but you know, constitution, etc...

maybe they had prior convictions then...its not cruel and unusual in the physical sense, but it is public humiliation sanctioned by the courts.Also it is not THAT common, and as such, i would say it is unusual...probably why it made the paper

Its not like we are cutting off their hands or something, its a sign. anyway, criminals should be humiliated, its a healthy part of making people feel guilty for their crimes.

I thought last year Wal-Mark changed their guidelines for the prosecution of shoplifters: "the retail value of the merchandise recovered must exceed $25, and the suspected shoplifter must be at or between the ages of 18 and 65.” Correct me if I'm wrong...I have a friend, now 23, who is trying to expunge a shoplifting charge from her record. When she was 16, her 14 year-old sister shoplifted something worth less than $10 from Walmart & somehow she has a record from her sister's transgression. I think you can only expunge something from your record once in your lifetime, so she is in the middle of that process, unable to get a "real" job in the meantime.

I did not read the thread, but I will throw in my .02. This issue was explored on an episode of Boston Legal, incidentally. For those who care.Anyhow-- I think this would be a TERRIBLE sentence if the "victim/suspect/convict" (whatever) was FORCED to wear the sign. She did it as a plea bargain of sorts, though, and I think that justifies it. She could have just as easily taken the jail time and avoided the humiliation, but served the sentence like anyone else would for a similar crime.Maybe she got off easy, but maybe in that process she was embarassed enough to learn a lesson.
