The old lady offered to settle for her medical expenses and was turned down by McDees. The lawyer explained McDees inexplicable decision to continue to hold their coffee at temperatures which would certainly cause harm. The jury was entitled to award punitive damages to punish McDees and they decided, after hearing all the evidence, to make a sizable award.Remember, she only sued for medical expenses, nothing more. i think the point was that it MAY be reasonable to assume that something you are going to drink won't give you 3rd degree burns in potentially 2 seconds. ive spilt coffee on myself before and not had a problem, but getting it pretty much straight from the kettle in a cup that preserves temperature might lead one to believe it has cooled down long before it actually has.

Third degree references the type of burn. THe degrees refer to the depth of the burn itself. First would be epidermis, second would be down to the dermis, third would be destruction of the skin itself with possible/probable underlying tissue damage. So a third degree burn does not necessarily mean its a total loss of tissue to the bone. Bottom line is SHE spilled it on herself. Its amazing that something so dangerous out there, that millions of people were somehow able to avoid her outcome with using what some term to be commmon sense.

It's a tragic situation. And without litigation, no company would ever eliminate hazardous practices, so such lawsuits have their place. Was it her fault that she spilled the coffee? Of course. Early factory workers were also technically at fault when they lost their fingers in the machinery, but the company ultimately was forced to bear some responsibility as well for preventing the dangerous situation in the first place.The fact that it took millions of dollars of settlement for McD's to change their practices can be blamed on the lawyers, and is another tragic situation.

why compare this to the mcdonalds case? That guy is an asshole, I am amazed they offered him 3,000 for his trouble......he should have taken that and run! Hope he loses his job.The McDonalds case is so different than what most people believe, the person was found to be at fault something like 25% and they charged McDonalds the amount they make in one day of coffee sales nationally, just so they would be forced to makea change. In the case of a small, single family owned business that didnt cause any damage, later found the pants and then offered to pay for his trouble.
