In a letter to the editor in today’s Washington Post, former National Labors Relations Board chief administrative law judge Melvin Welles urged “any bar to which Mr. Pearson belongs to immediately disbar him and the District to remove him from his position as an administrative law judge.”

To those of us who carefully study the litigation industry’s growing abuse of consumer protection laws around the country (see ATRA general counsel Victor Schwartz’s recent article from Executive Counsel magazine, “Consumer Protection Acts Are a Springboard for Lawsuit Abuse,” enclosed) and to everyday D.C. taxpayers who collectively provide Pearson with a considerable salary, his persistence in this lawsuit raises serious question about his capacity to serve the city as a “fair, impartial, effective, and efficient” judge, as required by the Office of Administrative Hearings Establishment Act.

If Pearson goes ahead with his lawsuit, any party who comes before him in future administrative hearings could understandably lack confidence in his judgment and judicial temperament. Furthermore, this case will become fodder for late-night comics, various members of Congress and other assorted critics of D.C. government if this case, scheduled for trial June 11, remains in the headlines.

Judicial temperament is a critical characteristic of an outstanding jurist. Any individual who chooses to pursue a case such as Pearson’s, at a minimum, calls into question his or her’s. As you consider his reappointment, we strongly urge you to examine closely his judicial temperament and decide whether it is sufficient to serve the people of the District of Columbia properly as an administrative law judge. "

The old lady offered to settle for her medical expenses and was turned down by McDees. The lawyer explained McDees inexplicable decision to continue to hold their coffee at temperatures which would certainly cause harm. The jury was entitled to award punitive damages to punish McDees and they decided, after hearing all the evidence, to make a sizable award.

Remember, she only sued for medical expenses, nothing more. McDees' attitude resulted in the large punitive award...

NO, because knives are known to be sharp, and irons are known to get hot, since time immemorial. I mean, that's what those thing do/are. An unsharp knife is not a knife, and an unhot iron is not an iron.

Similarly, coffee/tea are known to be made with boiling water, since the dawn of civilization.

i think the point was that it MAY be reasonable to assume that something you are going to drink won't give you 3rd degree burns in potentially 2 seconds. ive spilt coffee on myself before and not had a problem, but getting it pretty much straight from the kettle in a cup that preserves temperature might lead one to believe it has cooled down long before it actually has.

Third degree references the type of burn. THe degrees refer to the depth of the burn itself. First would be epidermis, second would be down to the dermis, third would be destruction of the skin itself with possible/probable underlying tissue damage. So a third degree burn does not necessarily mean its a total loss of tissue to the bone.

Bottom line is SHE spilled it on herself. Its amazing that something so dangerous out there, that millions of people were somehow able to avoid her outcome with using what some term to be commmon sense.

But it's not reasonable as it's clearly possible to get third degree burns quite easily from hot water. Hot liquids burn and burn severely, anyone expecting otherwise is a fool who deserves what they have coming to them.

Furthermore, if you think about the case, you have 1 of 2 possible scenarios. Either A) she's a regular at that McDonalds and has ordered coffee before or B) she was new to that McDonalds.

If A she's an idiot because she should know how hot they serve their coffee as she's been there before

and if B, she's an idiot because she ordered a hot beverage and stuck it between her legs without knowing how hot McDonalds serves their coffee.

It's a tragic situation. And without litigation, no company would ever eliminate hazardous practices, so such lawsuits have their place. Was it her fault that she spilled the coffee? Of course. Early factory workers were also technically at fault when they lost their fingers in the machinery, but the company ultimately was forced to bear some responsibility as well for preventing the dangerous situation in the first place.

The fact that it took millions of dollars of settlement for McD's to change their practices can be blamed on the lawyers, and is another tragic situation.

Unlike the factory workers, this old lady was not forced by any contract with McDonalds to:

1) Purchase the coffee
2) Place it between her legs
3) Attempt to open the cup of coffee
4) Do all of this while in her car.

It's not tragedy, it's grade A stupidity at it's finest.

why compare this to the mcdonalds case? That guy is an asshole, I am amazed they offered him 3,000 for his trouble......he should have taken that and run! Hope he loses his job.

The McDonalds case is so different than what most people believe, the person was found to be at fault something like 25% and they charged McDonalds the amount they make in one day of coffee sales nationally, just so they would be forced to makea change. In the case of a small, single family owned business that didnt cause any damage, later found the pants and then offered to pay for his trouble. What an asshole to push it past that, abusing the laws that he was supposed to be working against.
