no he cant, prove to me where it says u cannot consume alcohol in NC...being in ur system is totally ok, you just cant be in public over .08 but look on the ticket you got, that pink one...show me where it says being underage and consuming alcoholit says POSSESSING alcohol, but not consuming it...the case is how to prove u consumed it without possessing it
10/28/2005 4:00:00 AM
IM LYING it doesn't it says open containerbut in the end it doesnt matteryou still get cited for having alcohol and not being 21[Edited on October 28, 2005 at 4:01 AM. Reason : asdf]
10/28/2005 4:00:31 AM
manThere are going to be lotsa "open containers" on Franklin Street.
10/28/2005 4:01:45 AM
then that sums it all up, seriously dude i have researched this completely, talked with numerous lawyers about it and even the ALE, i even got busted for this myself thats why i know so much about it...i've never heard of a cop writing a ticket for a human being an open container but i guess its possible, but it would be thrown out in prolly 99 out of 100 cases. You can consume it but cant possess it, thats my story and im stickin to it.like i said, if u can prove u consumed it without possessing it u are ok but thats hardly ever possible.[Edited on October 28, 2005 at 4:03 AM. 10/28/2005 4:02:24 AM
its illegal to display alcohol in any public place in chapel hill i am not making that up
10/28/2005 4:03:12 AM
outside yes, it is, not public as in a bar or anything but outdoors
10/28/2005 4:04:03 AM
youve probably just never heard of anyone over the age of 21 being considered an open container, maybe that's because they can legally posses it
10/28/2005 4:04:14 AM
10/28/2005 4:04:42 AM
so taxi drivers can get pulled for taking drunk people home? that doesnt make sense at all, hell the wolfline probably breaks the law every night
10/28/2005 4:05:43 AM
^sense has nothing to do with local laws
10/28/2005 4:06:33 AM
okay now youre just being stupid
10/28/2005 4:06:38 AM
i mean really, as a lawyer thats what i would ask the judge...isnt a taxi driver against the lawbut this debate is really pointless...kid got caught with beer in hand in a picture...that is illegal regardless if its in him or not, /thread on that note correct?
10/28/2005 4:08:07 AM
yeah basically don't take incriminating pictures of yourself /thread
10/28/2005 4:09:11 AM
haha at least we agree on that muchwhere did u get caught though and how did u get out of it or did u
10/28/2005 4:10:56 AM
haha ive gotten out of a lot of things but yeah fuck you club oxygen
10/28/2005 4:12:20 AM
yea i was in a parkin lot off of trailwood right by the fire dept.and i got out as well, luckily, oh what a good lawyer as a good friend can do for you
10/28/2005 4:15:05 AM
I've heard of goody-two-shoes RA's before, but this is ridiculous (benefits of having an RA who had alcohol in him at least 8 hours a day).
10/28/2005 4:16:35 AM
Somebody should smack that RA for even allowing this to be Lounge worthy

I realize this is a viewpoint article, but I'm wondering if and where the whole "circumstantial evidence" falls under the current university policies. Whether it should be changed is another matter ... I'm curios if they could do it under the current system.[Edited on October 28, 2005 at 6:06 AM. Reason : .]

Alright, in its own right this is just rediculous. We all have at least one person on their friends list with alcohol in their pic, drugs, etc.So what is the purpose of my post? I encourage everyone to drink a can of beer tomorrow before going to class, take the can with you, and leave it somewhere out in the open. Don't forget your digi-cam! Take their picture when they least expect it when they pick it up and send it to campus police.Soon everyone will be gone for drinking in public and the campus will be mine... er... ours, muhahahahaha.... yeah. Maybe it'll be easier for me to get to my night labs without having to drive through stupid idiots crossing the street wherever they please.
10/28/2005 6:14:00 AM
who is the RA in question?Out that cunt.
10/28/2005 8:48:24 AM
yeahfirst of all, we need this RAs namesecond of all, I'm about to change my facebook picture to me smoking something out of a bowl and hope they just fucking try to prove that it's something besides tobacco. Or grass clippings, or ripped up pieces of tissue, or fucking anything.

I didn't read past post 2but a more severe example would be taking a pic of someone getting murdered then saying you can't use it as evidence bc of freedom of expression - it's either ok or it's not. A less severe example are the red light cams ... they suck for those who get caught, but then according to the law you shouldn't be doing anything to get caught anyway.
10/28/2005 9:01:43 AM
people who are drinking in their facebook picture are tools anyway ]
10/28/2005 9:02:04 AM
^^ There's a vast difference between those situations and pictures on a website.1) The container itself isn't what matters, but what's inside. How can you prove that there was alcohol inside said container?2) There's no way to ensure that a digital picture has not been altered. Someone adept with photoshop can easily put a beer can into the hand of anyone and it be impossible to tell that said picture was altered. Hell someone should photoshop a picture of this RA cunt with some contraband and turn that in to NCSU officials.
10/28/2005 9:05:22 AM
1. photoshop coke cans into their hands and bring the photo to court. 2. Claim that they are the originals3. profit[Edited on October 28, 2005 at 9:19 AM. Reason : r]
10/28/2005 9:18:54 AM
^hahaha that's actually not a bad idea. Find someone in design school who can make it seamless, print of the digital photos, and bring in the hardcopies to prove innocence.
10/28/2005 9:23:04 AM
i bet some RA got off writing some underage kid a drinking ticket. i know RA's have a job and all but why would they go out of their way to investigate and use circumstancial evidence to bust someone for underage drinking. i mean yeah if you are stupid enough to be having a case of beer laying on the floor when the RA walks in is one thing. you were dumb and deserve to get in trouble. But like last fall i had a friend who had a keg party in his dorm room, party went fine and never got in trouble. However, about 2 weeks down the road an RA just happened to be looking through the webshots of one of his suitemates and saw the picture of the keg party in my friends room. needless to say the RA felt like it was their buisness to write up my friend who ended up getting kicked out of the dorm over a picture. fucking bullshit if you ask me.
10/28/2005 10:43:37 AM
Some RA's just power trip because this is the most responsibility they've ever had.I'm so glad I had a cool RA in Bowen my two years in the dorms, be damned if I can remember his name though. Black guy studying for something in ministries on the 8th floor though. All of this over facebook pictures makes me a sad panda though.

10/28/2005 10:55:10 AM
so its just a university repurcussion? not an official RPD citation or anything?
10/28/2005 11:12:44 AM
as far as I know from my years spent RAing in Alexander, this has never happened before. Pictures could be used to clue in to a student with alcohol violations, like maybe on a rove you might check in on them more (it's not a dry dorm), but you have to actually catch them drinking or intoxicated to be written up. I bet the hall is up in arms about this.
10/28/2005 11:20:05 AM
I need the RA's name
10/28/2005 11:23:26 AM
needs a good old fashioned ass kicking.
10/28/2005 11:23:59 AM
i bet that RA lost a lot of friends. i think those students should kick that guy/woman's ass .it just pissed me off that these losers/ do-gooders think its their moral duty to go out of their way to bust those damn underage devil mongerers
10/28/2005 11:24:19 AM
one of my ex-residents told me that ABC News is there interviewing people. Hmm...that could be fun...
10/28/2005 11:35:20 AM
its funny because we forget we live in the bible thumping south until an incident like this rears its ugly head.i hope this catches the media attention it deserves and reminds the rest of the country that "NC State is just a redneck school"
10/28/2005 11:43:55 AM
they are interviewing people. they were doing it in my room but are probably done by now. they interviewed like 3 people so far, to the extent that i know.i HAVE to find out when that airs.

10/28/2005 11:55:24 AM
http://ncsu.edu/housing/general/alcohol.phpthis goes on top of what the university policies are...and just from personal experience (and about 500 judicials sitting in front of me) I can assure you they have prosecuted for similar actions before, and could easily prosecute these students on the basis of having a container in their room
