According to the lawsuit, badges worn around the casually dressed agents' necks were not clearly visible and the defendants did not verbally identify themselves as officers. The agents banged on the vehicle and shouted demands that Daly roll down the window and that she not start the engine. Daly, who claims she was frightened, did not comply.

One agent tried to break the window with his flashlight, and after another officer pulled a gun, one of Daly's two passengers shouted that the badges were fake and implored the driver to "go, go, go," according to the lawsuit.


Daly was charged with eluding police and assaulting a police officer after her SUV grazed two of the agents. The arrest provoked a public outcry, and the charges were dropped.

Her attorney, James B. Thorsen, didn't immediately return a telephone message left at his Richmond office Thursday morning.

"My goal throughout this case has been to reach a resolution that is just and fair for all parties, including Ms. Daly, the ABC and its agents, and the Commonwealth and its taxpayers," Herring said.

"After careful consideration of the potentially significant costs of taking this case to trial, I believe we have reached such an outcome."

Herring said the settlement was not an admission of wrongdoing by any of the parties in the lawsuit."

Nice to see that charges were dropped and she won her suit, but ultimately it doesn't make a bit of difference as long as cops have qualified immunity. Until the taxpayers stop paying for this shit and the individual officers are held responsible for their gross misconduct nothing will change.

Wake County police officers are barely qualified to direct traffic after Hurricanes games. Last thing they need is to be given access to military equipment. I'm sure they have it, though.

If anyone gets the magazine The Week, they recently had a good article about the militarization of local police departments, the increase in use of SWAT tactics for cases that involve non-violent offenses, increase in police brutality and the deaths that result, how they obtain the military hardware (iirc a lot of it comes from the new Dept of Homeland Security), etc. It's a good, short and simple read.

^^ one of the main reasons why I'm anti-military is because of the trickle-down effect of militarization. Tools that are used to kill civilians in foreign countries inevitably come back to the states to weaken public dissent.

^^i don't remember the article all that well, but doubt they gave a specific reason. i think a lot of it just has to do with the more recent access they have to the weapons/armor/vehicles. IT's safer for them to use it (and less safe for the citizens).

They had/have guys perched on top of trucks with DMRs. Why the fuck would snipers be needed in this situation?

The only time they should come out is there is a known armed shooter on the loose or a hostage situation or something.

Oh okay. So you think people who throw firebombs near police should be executed on sight, and with no less than a DMR, because a regular assault rifle is insufficient to kill someone 75 feet away.

Good thing the police are not quite as draconian as you, and are likely using the snipers as intimidation.

It's one thing to protest. It's another thing when fuckers in Missouri are fucking looting stores and vandalizing property. What the fuck does that have to do with a court's decision? Completely barbaric. I have no problems with the government taking those people out who are using the right to protest as an excuse for personal gain/vendetta in an unrelated case.

in the end the tragic result will be this:

1) no cops will be charged with anything

2) no changes will be made at the police department

3) black people / college students will flip out

4) it will be sensational for a short period of time (trayvon martin)

and it will mostly be because the looting / property damage got so much attention. should protesters learn to not do that in the future? maybe. do americans tend to miss the big picture? obviously.

Some of us have been banging the police militarization drum for fucking years now. It's a shame that it takes a massive protest like this to get anyone to pay attention to it.

Yes, the protestors have on occasion gotten violent, but the police are the ones who escalated the situation by tear gassing non-violent protests and firing canisters at people in their own fenced in front yards. This happened well before there were any molotov cocktails.

I don't know why anyone is surprised, like the old adage goes... "when all you have is a hammer everything starts to look like a nail." The police only know how to operate with force, so of course their response to any kind of perceived non-compliance will be with FORCE. They've been fed this "us vs. them" propaganda for so long that they don't know how to think any differently. It's shameful.

yep. the equipment needs to be scaled back. SWAT teams need to be only used for things that you need a SWAT team for. The 4th Amendment needs to be respected and abided by.

Most importantly, the whole culture needs to change in a big way, and it's pretty thoroughly ingrained. There are so many cops who think they're some sort of damned ubermensch, with contempt for the common citizen. I think that we need fewer cops, but they should be more highly paid and qualified-college degrees, etc. If we scaled back the war on drugs, we could have fewer, better cops.
