Is the loop hole that she did not actually strike the other vehicle?

I'm not a lawayer, so if you are please chime in. Never been in this position but it was explained to me like this:If you charge someone with an infraction - which I believe driving wrong way on dual lane is - and that driving causes a death and you are charged with that death, you can plead guilty to the citation (by pre-pay) and the other charge becomes double jeopardy because its not a lesser included offense. Might be wayyyy off base and they may have changed the law in 2010 or 11.

http://www.wral.com/news/local/story/11604448/17-year old that killed a girl in January only got 6 months. Of course, that's way more than Vince Neil got for the same thing.

I think they went too easy on him, he was on probation when this happened, he does not catch on quickly.
9/28/2012 9:13:31 PM
this fucker should rot in prison for a lot longer than he got.
9/28/2012 9:14:20 PM
Makes me sick. It's like a winter break to jail Doesn't even have to miss christmas
9/28/2012 9:25:21 PM
did he force the girl to get in the passenger seat?
9/28/2012 9:27:25 PM
^ good point.Except when he went flying through the subdivision across yards and in to a tree, there is no telling how many more people would have been taken out had they been in the way. This guy is above and beyond driving drunk, he was driving like a stupid asshole on top of that, and he was on probation. I am all for giving people a pass once in a while for momentary lapses of judgement, but this guy obviously does not give a shit about anything. Imagine you were out walking your dog and then lights out. . . . .
9/28/2012 10:23:27 PM
i'm not defending the guyi'm just saying
9/28/2012 10:51:12 PM
All sorts of people fucked up leading to that accident. GG a life lost and so many more went to shit. DO NOT DRIVE DRUNK
9/28/2012 11:03:00 PM
One reason that they don't decide to put BAC's in cars is because people will sit there and wait until they can blow a .08, then don't drive as smart because they assume they're at a "safe level" to drink... Just because you blow a .08 doesn't mean you are making a good choice. They could be on something else or extremely tired. They would try and leverage it as defense in court, too. And yeah it would be expensive to put them in every car.
9/29/2012 12:43:56 AM
Keep in mind that the fact that he was on probation at the time of his crime will now result in a revocable violation of that original probation case. It is likely that he could serve his active sentence on the original case in addition to the 6 month split sentence just handed down. Additionally, 5 years is a long time to be on probation, particularly for someone his age. The likelihood of him winding up in violation court during that time is fairly high
9/29/2012 2:38:05 AM
yea but this kid spending 6 yrs in prison won't do anything but make him part of the system and likely a repeat offender. So maybe their idea in sentencing was to rehabilitate this kid.I hate this kid and his stupid decisions, but I also believe in drug courts. That being said he killed a person and that is a criminal offense, and 6 months is kind of bullshit.I think they are hoping this kid will get an education during his probation and make something of himself. lulz
9/29/2012 10:45:09 AM
9/29/2012 11:32:03 AM
^^That's exactly what the article said. It's retribution and rehabilitation. That's why they aren't pushing for more than 6 months. The Judge wants this guy to make something out of his life, so the girl didn't die in vain.

By the way, I don't know what kind of program they have in North Carolina, but I had a buddy in South Carolina who couldn't drink or do drugs for a whole calendar year....and it was literally impossible for him to do either. He got blood tested once a week with two "random" tests a month in addition. He unfortunately turned back into a mess after those 365 days (man in his older 30s...he's way past changing)...but I was pretty impressed with how they kept him from doing anything.
9/29/2012 1:35:04 PM
For a while there pretty much everyone on probation in NC was getting violated for any minor slip up, like it was virtually impossible not to get violated...that was right after Eve Carson, so I am not sure how much it has relaxed since then.
9/29/2012 5:59:48 PM
the girl chose to ride with a drunk driver and was probably drunk herself.
