Question: If you are an alternate juror, do you have to follow the same rules about media accounts blah blah during the trial, even if you're not in the jury box?
5/3/2011 6:12:11 PM
Yes.My wife was an alternate (for a different case obviously). She couldn't talk to anyone about the case until it was over - even as an alternate. I didn't find out what the case was about until it was over. And the jury not reporting back almost immediately is a bit troubling. Probably a majority that want to get BC on 2nd degree - after the explanation the judge gave. Which of course is the reason it was tacked on at the end. They realized they'd never get 1st degree, but they could possibly make 2nd stick. They really are hard pressed to lock up BC over this when they should be reopening the investigation.[Edited on May 3, 2011 at 6:17 PM. they still deliberating or home for the day?
5/3/2011 6:14:49 PM
^^ your wife is better than me. I have little doubt I would blab to my husband
5/3/2011 6:17:09 PM
Isn't 2nd degree murder still life in prison. What does it matter?
5/3/2011 6:17:30 PM
^As far as being in jail is concerned, not much I guess. As far as the trial, because they would probably never be able to get him for 1st degree, so 2nd was tacked on to make sure they got him with something. It's been too long since the judge explained 2nd degree to the jury so my memory is shot. I'd have to go back and watch the feed to get his exact words. All I can remember is that he explained that all that was needed was circumstantial evidence, and what little the prosecution had was circumstantial evidence. I just took it as more bias from the judge, almost as if he were leading them down that path.[Edited on May 3, 2011 at 6:39 PM. Reason : -]

It's my understanding that juries aren't allowed to know how many years various sentences are. It's another way to encourage them to vote guilty...on something. Crooked system.
5/3/2011 6:40:25 PM
I agree that the judge added second degree murder as part of his way to convict brad Cooper at al costs. The more than immediate deliberation at all doesn't bother me since I have seen lesser offenses take an hour or more. I once witnessed a friends dwi take a out that long. (his dwi initially was in district court but went to superior for appeal.) However- not to contradict myself- but James Crouch once told me a black female is the worse person to have on a jury because they are ready to convict.
5/3/2011 6:51:56 PM
How can we get the judge removed from the bench?
5/3/2011 6:53:47 PM
Can you just "add" a 2nd degree murder charge? Do you not need an indictment?
5/3/2011 6:54:11 PM
He'll allow it
5/3/2011 7:06:21 PM
The prosecution's closing argument was the worst shit ever. Content aside, the presentation was worse than what you see in freshman public speaking classes. If my juror experience about a bad roofing job is any indication, this deliberation is going to be a nightmare.I like how no evidence that Brad is the killer means Brad did it. No evidence of computer tampering means there was no computer tampering....and lol at Boz for emphasizing FBI, as if it's some infallible organization.[Edited on May 3, 2011 at 7:50 PM. Reason : ]

it's not really adding. it's in lieu of murder one. if sufficient to indict on murder 1, it should be sufficient to indict on murder 2
5/3/2011 8:31:50 PM
I don't see how Second Degree is a viable option here though. It's either premeditation (if you buy the map) or not guilty (you don't buy the map, it's planted, and they're framing him). I don't see how there's possibly a middle ground.
5/3/2011 8:45:39 PM
thats true.
5/3/2011 8:50:11 PM
If those charges don't work they'll add in 3rd degree Jaywalking.

i know i'm hours late on this, but i'm just now watching boz's closing statement. was anyone else reminded of dwight shrute when he kept saying "FACT....., FACT................, FACT.............." i nearly died laughing. i hope the jury reached a not guilty verdict tomorrow.
5/3/2011 11:58:29 PM
^^he confessed...
5/4/2011 12:15:18 AM
I am watching Boz closing statement now. While watching it I also drafted a letter to Wake Co DA Colon Willoughby that I'm going to send him to air my thoughts about the incompetence of his office.Boz really irked me when he described how he works for the state, and they represent all of us including the tornado victims! i know, that sounds crazy, if you don't believe me watch the closing statements yourself.
5/4/2011 12:30:21 AM
he did? fuck, i missed that.good for you for writing the DA. these two clowns are jsut fucking retarded. and then when something insane happens, like cooper gets convicted, willoughby will do nothing about it.
5/4/2011 12:51:39 AM
I told you guys Willoughby washed his hands of it because he ain't trying to get Nifong'd up in this shit.I would not be surprised in the slightest to see a not guilty come down and Cummings and Boz find themselves working down at the snack bar the next day.
5/4/2011 12:54:33 AM
Boz
5/4/2011 12:55:59 AM
So what are the chances the jury comes back with a verdict today?
5/4/2011 7:20:56 AM
^No way of knowing. The one interesting thing... and I guess nothing can be read into it now. That juror that had a conflict on Thursday. Initially they were going to be dismissed, which could be interpreted as they planed on taking a long time to deliberate. Then they weren't dismissed because they could "work something out."Don't know if they moved whatever other appointment they had or the juror realized what day it was and fully expected to be done with deliberations before their other appointment.
5/4/2011 7:47:52 AM
^The juror with the Thursday conflict was dismissed, and an alternate took her place.
5/4/2011 7:51:20 AM
Oh, I thought they were back and forth for a while. I guess it settled on them being dismissed.
5/4/2011 7:58:43 AM
^^That is not how I interpreted WRAL's tweet.
5/4/2011 8:05:14 AM
The ducks were found...and the router is at the bottom of the lake where someone will trip over it years from now...how can Brad be judged guilty?
5/4/2011 8:07:03 AM
5/4/2011 8:09:00 AM
^^no a canoe will bump in to it at the bottom of the lake. Submarine canoes spotted in Cary!
5/4/2011 8:58:05 AM
I thought they dismissed the juror, brought in an alternate, and then ditched the alternate because the original juror worked out his conflict.
