5/2/2011 5:15:12 PM
not guilty
5/2/2011 5:15:21 PM
:/Asking "guilty or not guilty" is not the same as asking if the state has proven without a reasonable doubt that BC planned and carried out the murder of NC.
5/2/2011 7:15:43 PM
are you kidding me dude
5/2/2011 7:22:03 PM
Well hell yeah I think he killed her but hell no the prosecution didn't (couldn't) prove it. So not guilty does not equal innocent.
5/2/2011 7:31:34 PM
if the prosecution couldn't prove it, then that means he is not guilty. there's no other interpretation of that.and honestly if you believe that he did it after the overwhelming evidence presented to the contrary, then I really have to question your sanity
5/2/2011 7:45:30 PM
The only overwhelming factors in this case are the strange and unexplained actions by the defendant.[Edited on May 2, 2011 at 8:01 PM. Reason : you act as if a murderer has never been found not guilty?]
5/2/2011 8:00:59 PM
So are we going to have a riot in Cary after this or what?
5/2/2011 8:02:11 PM
5/2/2011 8:32:55 PM
If she ran, then acquit this man
5/2/2011 9:23:22 PM
that's appropriate, but im not sure it has enough heft behind it
5/2/2011 9:26:09 PM
kiljadn should do the defense closing arguement.
5/2/2011 10:46:32 PM
Someone in this thread needs to run into the courtroom and yell this shit...even it if means being in contemptThe fact that the judge has let this go 10 weeks is fucking retarded.
5/2/2011 11:14:31 PM
I volunteer you

jury's backnot guilty on first degreeguilty on second degreewtf
5/3/2011 8:39:43 AM
LIES!
5/3/2011 8:43:36 AM
^^ hahaha...that would suck if it were true since the judge threw in the option of second degree at the last minute even after objections from both the prosecution and defense. today should be interesting to see what both sides say in closing arguments.
5/3/2011 8:49:19 AM
hopefully the jury doesn't cop out and convict for second degree.
5/3/2011 8:54:02 AM
Why would the judge add in the other charge at the very end of the trial?
5/3/2011 9:01:45 AM
5/3/2011 9:05:32 AM
What that sounds like to me is based upon what the judge has seen you can get 1st degree but you stick him with 2nd.
5/3/2011 9:10:07 AM
innocent until proven guilty seems to be a lost concept among you people.
5/3/2011 9:10:59 AM
This sounds like he knows he's let this dog and pony show go on when it shouldn't have and he's vainly trying to save face by hoping the jury will bite on 2nd degree.
5/3/2011 9:11:51 AM
Clearly the judge saw there was no chance anyone could convict him of murder, let alone premeditated murder so he was like "hey lets throw in another so I can get a murder conviction on my resume"
5/3/2011 9:13:19 AM
"After the closing arguments, Judge Paul Gessner will also instruct the jury that second-degree murder, which does not require evidence of premeditation or intent, is also an option.I think that's what he meant.[Edited on May 3, 2011 at 9:18 AM. Reason : .]

5/3/2011 9:15:43 AM
Did she have the necklace on at the party the night before she died?
5/3/2011 9:17:03 AM
So he's tossing a non-premeditated charge over the fence? I guess he thinks all that stuff about him looking the dump site up on google the day before and checking out and setting up equipment to spoof calls is a load of bull.
5/3/2011 9:18:48 AM
^ that's a good question because if he supposedly strangled her after the party and she was wearing it, it wouldn't make sense for him to remove necklace.
5/3/2011 9:21:35 AM
The thing is, if its not premeditated, then what little the prosecution has is gone. Second degree murder is absolutely impossible in this case.
5/3/2011 9:21:43 AM
^^Exactly. But being that he dropped $7000 on that necklace if she was wearing it at the party (originally planned as her "going away" party) and she was found without it...[Edited on May 3, 2011 at 9:23 AM. Reason : erererer]
5/3/2011 9:23:16 AM
^5 probably a pearl necklace from one of the dudes she was banging. video showed her not wearing it at the teeter day of, but i have not seen anyone testify that she had it on at the party, but i missed a lot of the early on testimony.[Edited on May 3, 2011 at 9:24 AM. Reason : 5]^ but once the cops find the body, i think, if you are not guilty or say a drunk driving case then the family (he or the parents) would receive both the earrings and necklace back after sometime. i would think the jewelry would be given back to him or her parents. i don't see why the police would need to keep it as evidence forever.
