Cops lie all the time, and I'd probably side with the kid regardless...but I don't see how that picture is evidence that the kid wasn't doing donuts.

Did I fail logic?

I guess if he did do 360s, the cop would've taken pictures. Or maybe he thought he didn't have to present evidence in court, since nobody is gonna believe some little ghetto boy over a good upstanding law enforcement officer.

The officer's report says "Skid Marks show clear 360 degree circles". Howevever, the picture shows nothing of the sort, only skid marks veering off to the side, as if he was trying to avoid something in the road.

Of course, but that picture could be taken anywhere or of any section of road. There's nothing convincing about it. If anything, stuff like that makes me more suspicious.

^^Yeah, the absence of police evidence is the damning part.

I kinda wonder if some DAs know that certain cops in their jurisdiction are often full of shit, not all the time, but often enough that when they are presented with some evidence, it's enough for them to be like "not this shit again."

^^^I know that cameras record location data. But, even then, there could be 360 degree tire marks just out of view. There aren't, but there could be.

Anyway, I don't wanna take away from the broader point that police lie all the time.

^^I'm sure they do. My favorite day in court was the one where a judge fussed out two cops, advising them to not come in his court room with their garbage again!

But that's all that happened to them--they were just embarrassed a little and sent on their way.

Frankly that probably includes this post, but I'm really not a fan of taxpayer-funded personnel acting like kids when I've worked my ass off to be above-board and professional since before I was licensed.

Have been writing at lawdevnull.com for years, but haven't had the time really since I started my law firm a few years ago -- Twitter is faster and can be done on the phone while I'm waiting around in court

There were/are more pics, but Rule 1.6 limits what I'm allowed to disclose if it could potentially reveal my client's identity (at least until I have a written waiver) -- if I posted both that pic and the pic from the other direction, it'd be obvious to some folks where that happened / who he was.

Hoping to have green light to disclose everything soon

Conspiracy theorist thrive on mere bits of information so they can make superficial connections to feed their nutty theorists. If it took you many hours to try this case, you're not going to be able to convey this in a few tweets or even an article. The whole Netflix documentary of making a murderer wasn't even able to capture all elements of the case in 9 hours.

Unless you want the make this discussion about this specific person and this specific case, you don't benefit by spending time organizing and releasing more information here.

You already have credibility on the issue of law, and the issue of civil rights, you shouldn't feel the need to validate the skeptics here-- it won't work (IMO of course).

I'm always amazed and a little frightened about how stories like this highlight how many cop-lickers there are out there. They seem to crawl out of the woodwork to demonstrate their complete obeisance to the police as if they could do no wrong.

So the witness was lying. The cop was lying.

The only 'evidence' was provided by the mother of your client. Heaven forbid you take your own photos.

One thing is certain, given that Street and the length of the skid marks, he was clearly hauling ass.

Also, how do skid marks from a car make a 'V' like that?

He swerved to miss a cat, yet someone saw him long enough to get his license plate, call the cops and they get there in time to catch him? I swerve to miss a cat, i keep going. Story is BS.

To immediately blame the cop of being racist is lazy.

Seems like a Johnnie Cochran wannabee jumping on the 'blame the cops' bandwagon.

How those skid marks were probably created:

https://www.youtube.com/watch?v=PsO3TiFqokg

If the road was wet, i could see this happening from just someone slamming on their brakes.

I can see this being a failed attempt at a doughnut. I can see this as being a speeder wrecking after dodging a cat. I don't see this has being a racist cop.

There's no evidence that the witness was lying.

There is absolutely evidence that the cop lied, given the photo and the report:
Quote :
"The officer's report says "Skid Marks show clear 360 degree circles"."

Quote :
"One thing is certain, given that Street and the length of the skid marks, he was clearly hauling ass."

Note that in the photo the road is wet, which decreases the skid resistance of the road surface and increases the stopping distance. Also, nowhere is it stated what type of vehicle was involved. Given that the mass of the car, type/condition of brakes and tires are all unknown, you cannot possibly conclude with any certainty that he was "clearly hauling ass"

Quote :
"He swerved to miss a cat, yet someone saw him long enough to get his license plate, call the cops and they get there in time to catch him? I swerve to miss a cat, i keep going. Story is BS. "

There was no mention of the neighbor calling the cops, just the alleged statement from a neighbor to the cop. It makes no mention of how the cop caught the kid, so it seems like you're filling in blanks with your own narrative.

^^Well, that kinda gets at a point I haven't felt like mentioning, but whatever...

Is the cop lying, or is the cop imprecise and/or stupid and/or mistaken?

"Skid marks show clear 360 degree circles"

Skid marks can "show" that something happened, but most of us would say "indicate" or "demonstrate" instead. Skid marks can also appear or be in a certain pattern on the road. But skid marks don't exactly show a certain pattern on the road.

If anyone's still bothering to follow, it's the word, "clear," that makes it look like an obvious lie to me. But if you flip that word in front and add -ly, we've got a whole nother possible idea being expressed:

"Skid marks clearly show 360 degree circles"

I know I look crazy, but the cop's unclear wording has been bothering me.

Also, I can actually see how a neighbor might see just when the kid swerved and rotated and then honestly report that as "doing donuts" to the officer. And maybe the kid was like me and had a reputation for reckless driving in the neighborhood.

It's not that important, but Hanlon's razor is a real thing and stuff.

To be clear, I do believe that charges are generally trumped up to keep more money coming into the system, but the single case here is weird to me.

^^thar kind of absolute language is pretty common when cops are caught doing something wrong. I think they're trained to be absolute, it would look pretty bad if they said "suspect was maybe doing donuts, but it's not really clear" and then Arrested him.

You can pull the police reports from Tamir rice or John Crawford or Eric brown or Sandra bland, Etc., and find embellishing or straight lying about what happened when compared to video.

It's not supposed to be like a news report that's unbiased or well sourced.
