"That was my round," said Haith. "Evidently, it went through his body and struck the wall."

Pandemonium followed, and the intruder scurried out. An apparent getaway vehicle spun out of Haith's yard to pick up the intruder, who had collapsed outside of a day care up the street.

By that time, Haith had dialed 911.

"Once-in-a-lifetime incident that I hope doesn't happen again," said Haith.

The Vance County Sheriff's Office hasn't officially released any details of the incident.

According to Haith, both the driver and the shooter were taken into custody. He says the intruder who he shot was last listed in critical condition at the hospital.

Haith said nothing was stolen from his home."

if we believe that article exactly as it is written, then i would say this is an illegal shoot.

I am not saying I would have made the same decision, all I am saying is if they were badass enough to kick his door in, tackle him and break his collar bone, then rob his safe. (mind you this guy is a feeble 80 year old man) I don't particularly feel bad for them.

i'm sure he felt victimized as he just got the shit kicked out of him. i'm sure shooting her felt like good old fashioned justice revenge... but as time goes on we will see if he begins to regret it. i certainly would be mad as hell and WANT to hurt the people who just hurt me, but part of being a responsible gun owner (or any weapon) is to know when not to squeeze the trigger. his life/well being was no longer in danger and to me that isn't a justified use of deadly force.

If the police charge the old man how are they gonna charge the co-conspirator in the robbery with murder? In most states co-conspirators are legally guilty of murder if someone dies in the crime. (including another co-conspirator)

If crime a is a felony and person b dies then all people involved in crime a get charged with murder.

This law is usually so cops can make a deal with the people that didn't pull the trigger to get off.

“He sustains a broken collar bone, cuts and bruises, as a result of that beating. They leave him… he’s able to get up, and at that point he goes into another room, retrieves a gun and comes back and confronts them once again,” McDonnell said.

Greer then opened fire inside his home and again outside as both suspects fled the scene with items taken from the home, according to a news release from the department. The female was struck by gunfire and died at the scene.

She was later identified as 28-year-old Andrea Miller of Long Beach, the release stated. The Los Angeles County coroner’s office was working to determine whether Miller was pregnant, police added.

The male suspect, identified as 26-year-old Gus Adams of Long Beach, was later arrested and was being held on charges of murder and residential robbery, according to the release.

Adams was being held on more than $1 million bail.

Greer told police his home had been burglarized before, and he believed the two suspects were responsible for the prior incidents.

Both Adams and Miller had criminal histories, police said.

An investigation into the incident continued and anyone with information was asked to call Long Beach Police homicide detectives Mark McGuire and Greg Krabbe at 562-570-7244."

The better question is, would a jury convict the old man of murder if the charges are actually filed?

If she actually was preggers: yes
If she lied: probably not
