Four months ago my roommate and I found a third roommate on Craigslist. She is an "executive" at an international company based out of Cincy, and if I had to guess makes $200k. She had just sold her house and most of her stuff, and indicated she would be moving soon. We at first told her we didn't really need her to sign a lease, but she encouraged us to write one up so if/when she left early, her company would buy out the remainder of the lease. We thought that sounded like a pretty sweet deal, so my other roommate's lawyer friend drafted up a pretty standard lease and she signed it.

She just told us she is being transferred to Australia, and that her company *might* pay for 2-3 months, but if we want more than that, "we'll have to go up against their legal team". Then, later that night, she tells me all about her $60-80k bonuses and expense reimbursement she is getting for moving over there.

My question is, what the fuck does this have to do with the legal professionals at her company? They aren't on the lease, they have nothing to do with this. If SHE wants to be reimbursed for paying off the remainder of the lease, then she needs to take that up with them, AMIRITE?

You can't just make an offer and walk out on a residential lease, right?

seems pretty straightforward. she signed a contract, she must play by the rules. saying she has a legal team is a scare tactic that is obviously working. tell her to take her yarmulke off and pay what she owes.

I mean, you guys didn't even want her to sign a lease because you knew this might be coming right? If her company pays 2-3 months, that's pretty awesome and would allow you time to find somebody else, and maybe even profit about off it.

^^well, I tried to explain her situation so it made more sense (why is someone with so much money renting, from craigslist, with two other people). she's kind of a hippy in general, but I think this was just a matter of convenience. she is single, 35, had sold all her stuff (and her house), and was planning on being relocated soon.

so she got a really nice house that is fully furnished with everything she needed, and besides that, she is absolutely the laziest and most inconsiderate person I've ever met (in terms of cleaning up after herself, contributing to the welfare of our home, etc), so she got two built in housekeepers.


^we didn't see a need for her to sign a lease because generally our experience with other roommates has been pretty casual, and trusting. She was saying "hey, have me sign a lease, because that will be a great deal for you!" she didn't tell us she was most likely going to be relocated until after the lease suggestion. the ad was for 1 year. If we had known she was going to be dipping out and we were going to have to start this whole roommate-search process over again in 6 mos, we never would have chosen her (there were several other legit, likeable candidates).

I'm applying SC landlord/tenant law...but basically you have to make a reasonable effort to rent out the room. If you can't find a tenant, then she's obligated to pay her share of the rent.

You should be able to get a couple months out of her and then find someone to fill in the room. Doesn't sound like a huge undertaking.

^yeah, that's what I thought. but what is considered a "reasonable effort"? should we have to settle for some scab because it's been two months without anyone awesome responding? she insinuated the same thing when we first discussed this upon meeting her, and she was just like "you'll just have to keep posting the ad on craigslist, and if it comes down to it, be able to prove that you've responded to some of the emails"

slappy, do you or the other roommate own the place or are you also renters? If the "lease" you had the 3rd roommate sign was actually a sublease, you're fucked.

This is the real question here. Why is someone making that much money living with roommates to begin with? Hell my top budgetary priority is allocating enough money to be able to afford my own place.

Yeah...that last sentence is about right. Obviously you have a little discretion in who you choose to rent out the room...but once someone reasonable comes up, you should probably let them have the room.

^^^we rent. so it's technically a sublease, but I don't think she knows that. I figured that would be the case, but I'm hoping it doesn't come up and she is a reasonable person. I'm willing to work with her and come up with a compromise, but I *hate* when people try to screw me over, especially given the circumstances (her doing the bait-and-switch), and the fact that she's trying to intimidate me with the fact that her "legal department" will be getting involved.

If there really is a corporate legal team (there isn't) it would be cheaper for them to buy out a low cost residential lease than actually defend the matter. They're not going to send a $500 an hour lawyer to small claims court.

you are correct. she is responsible for paying the amount of the remaining lease that her company doesn't.

Yeah, it still sounds like a pretty good deal to me. You weren't even going to have her sign a lease in the first place, and it sounds like you're not technically even in a position to be enforcing a lease...

You should probably be nice to her and try to get that 2-3 months of rent either from her company or from her. It sounds like her employer will probably figure out that she doesn't actually owe you anything...so, if you want anything at all for your trouble, do not punch her in the cunt.

AHA, she does sound sketchy.

However, it seems like the only person who is violating a valid lease is slappy1.

And, as far as housing resolutions go, this situation is practically ideal. Just find another roommate...that's kind of how it goes.

I think it's fine that she did so informally, and I'm not judging or anything, but I'd be pretty darn happy with 2-3 months paid rent while I found another roommate. There's just nothing here to get cunt-punchy about.

But djeternal's position is that this slappy1 signed a lease as an individual for a place for 3 people that forbids subletting. Why would anyone ever be stupid enough to sign such a lease?

There would be a case if sublets don't have the same claims to future rent that an owner who drafted a lease does. There's no reason to believe that, and no one has really claimed that directly. So meh.

shady job situation aside, judging by the text conversation it seems like your roommate is acting perfectly reasonable. you wouldn't have even had a lease if she didn't suggest it. Even if you can pursue her legally, it's almost surely not worth it.

1. Be nice
2. Take your 2-3 months rent payments
3. Find new roommate that you actually like
4. ....
5. $Profit

Sounds like a good deal all around to me. Not sure why you are getting assed up about it.

IT'S NOT FREE MONEY. THERE IS STILL 1/3 OF THE RENT THAT WILL NEED TO BE PAID

why should I have to rush and accept any subpar potential roommate just because she decided to dip out early? I'm too old to be sharing a house with shitty people just because I need the money.

Our house is the shit and my living situation, up to this point, has been awesome. I'm not going to settle just because she's reneging on an agreement.


^there is a lot more frustration leading up to this point in the story, mostly revolving around her being inconsiderate, lazy, 2-4 weeks late on rent nearly every month, my passive aggressiveness/not voicing our concerns, her disgusting cat, etc.
