A friend of mine (no, it was not myself) had a car that he was fixing up, eventually finished it, and posted it on Craigslist. Some guy came to look at it on a Friday and then the next day called and said his car died and he'd like to buy my friend's ASAP and ended up picking it up late Saturday night. My friend had the title for the car.

Since the DMV wasn't open and they couldn't find a notary that late, the guy paid the asking price in cash and they did a Bill of Sale and my friend gave him the title to take with him in case he was pulled over since the car had no plates and they agreed to meet up the following week to get the title transferred over. In retrospect, that might have been a dumb idea, but my friend figured he couldn't really get in trouble since he wasn't driving and he didn't provide any plates, so what's done is done.

Well, the guy who bought the car lost both the Bill of Sale and the title. Neither of them are sure what you do in this situation - my friend still has the original Bill of Sale with the VIN on it, and it's still in his name, so I assume he can just apply for another title? The buyer said he'd pay whatever that cost, obviously, but is there any way they can just apply for a new title in the buyer's name and forgo getting another title just to sign it over?

They have "fill in the blanks" replacement title forms at the dmv, you just need a good reason to ask for one. If you're worried about the buyer, have him accompany your "friend" and do the entire deed at once at the dmv.

as long as you got the cash, youre good to go.

since the title and BOS was lost, technically you can go file for a lost title, get the car back and re-sell it. hah

idont know if this works in this case but they havve the MVR4(duplicate title) form online.

this is kind of a stupid question.. did your friend consider spending 45 seconds looking on the dmv website and seeing that he could just get a duplicate title?
